1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form received by the Local Planning Authority on the 21 December 2016 and the revised plan received by the Local Planning Authority on 15 May 2017. The reason for the condition is :- For the avoidance of doubt.
3.The restaurant hereby permitted shall not be open to the public outside the following hours: 09:00 to 00:00 hours Sunday to Thursday 09:00 to 02:00 hours Friday and Saturday The reason for the condition is :- For the avoidance of doubt and to ensure the amenities of adjacent residents.
4.Notwithstanding condition 3 of this permission the balcony shall not be used outside of the following hours: 09:00 to 00:00 hours on any day The reason for the condition is :- For the avoidance of doubt and to ensure the amenities of adjacent residents.
5.No work shall commence until the exact type, form, material and finish of the balcony enclosure have been submitted to and approved by the Local Planning Authority. The development shall be carried out using the agreed materials. The reason for the condition is :- In the interests of the visual amenities of the area as precise details of the materials have not been submitted.
6.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria outlined in polciies CS8, CS9 and CS10 of the adopted Core Strategy and saved policy SHP14 of the Borough Wide Local Plan.
7.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
