| 1. | The location plan does not include land required to access the site from the public highway outlined in red. This is a requirement of Article 7(1)(c)(ii) of the Town and Country Planning (Development Management Procedure (England) (Order) 2015. |
| 2. | The application site is located within 400 metres of a Natura2000 site (North Denes SPA) although there has not been a bespoke HRA submitted as part of this application. Therefore the Local Planning Authority cannot be certain that there will not be any adverse effects (either direct of indirect) on the designated site as a result of this proposal. Moreover, the proposal is for one net new dwelling and no HMMS payment has been received. Therefore the Local Planning Authority would not be able to secure the appropriate mitigation. The application is consequently contrary to the core aims of Core Policy CS11 which seeks to avoid any harmful impacts of development on its biodiversity within the Borough. |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
