No.Condition Text
1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form and approved plans (drawing reference: 7051 PL01, 7051 06 Rev F, 7051 07 Rev E, 7051 08 Rev E and 7051 10) received by the Local Planning Authority on 20 September 2016 and the revised plan (drawing reference: 7051 05 Rev J) received on the 15 November 2016. The reason for the condition is :- For the avoidance of doubt.
3.Development shall not commence until a scheme detailing provision for on site parking for construction/demolition workers for the duration of the construction/demolition period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented throughout the construction period. The reason for the condition is :- To ensure adequate off street parking during construction in the interests of highway safety.
4.Prior to the commencement of any works a Construction Traffic Management Plan and Access Route which shall incorporate adequate provision for addressing any abnormal wear and tear to the highway, protection of the highway and users thereof, keeping highways clear of debris, tec., shall be submitted to and approved in writing with the Local Planning Authority in consultation with Norfolk County Council Highway Authority together with proposals to control and manage construction/demolition traffic using the 'Construction Traffic Access Route' and to ensure no other local roads are used by construction/demolition traffic. The reason for the condition is :- In the interests of maintaining highway efficiency and safety.
5.For the duration of the construction period all traffic associated with the construction/demolition of the development will comply with the Construction Traffic Management Plan and use only the Construction Traffic Access Route and no other local roads unless approved in writing with the Local Planning Authority in consultation with the Highway Authority The reason for the condition is :- In the interests of maintaining highway efficiency and safety.
6.The beer garden hereby approved shown on drawing 7051 05 shall not be in use between the hours of 11:00pm to 8:00am on any given day and shall not be open to the public during these hours. The reason for the condition is :- To ensure the amenities of neighbouring residential uses are not significantly and adversely affected by noise pollution.
7.No work shall commence on the development hereby permitted until details of any plant, air conditioning and odour extraction equipment have been submitted to and approved by the Local Planning Authority. The details shall include a noise impact assessment regarding the potential impact of the plant on neighbouring properties. Any plant and equipment shall be installed and maintained in accordance with the approved details. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
8.Any lighting inserted within the beer garden hereby approved (shown on drawing 7051 05 rev J) shall not shine directly towards any neighbouring property and shall only illuminate their intended surface. If lighting is sensor controlled they must operate so they only pick up the movement of persons in the beer garden and not beyond. The reason for the condition is :- To ensure the amenities of neighbouring residential uses are not significantly and adversely affected by light pollution
9.Prior to the commencement of the use hereby approved the bin storage area (shown on drawing 7051 05 Rev J) shall be completed and the bins shall be stored here in perpetuity. The reason for the condition is :- To ensure the bins are not stored inappropriately which could adversely affect the setting of a conservation area.
10.No heating apparatus or any equipment of any kind shall be placed on the public highway without the prior consent in writing of the Local Planning Authority. The reason for the condition is :- For the avoidance of doubt and in the interests of visual amenity.
11.The tables and chairs positioned on the public highway as shown on the approved plan shall be removed from the public highway outside of the hours of 09.00am to 11.00pm and shall only be sited on the public highway within the area shown on the approved plan (drawing reference 7051 05 Rev J) unless otherwise agreed in writing with the Local Planning Authority. The reason for the condition is :- In the interests of highway safety and to ensure that the use of the does not create significant problems of loss of amenity for nearby uses.
12.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria outlined under policies CS7, CS8, CS9 and CS10 of the adopted Core Strategy.
13.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
