1.Criterion (l) of Policy CS6 of the Great Yarmouth Local Plan: Core Strategy states that the Council will encourage flexible working by allowing home working where there is no adverse impact on residential amenities. Saved Policy EMP18 of the Great Yarmouth Borough-Wide Local Plan states that small scale businesses within existing settlements will be permitted provided (A) the proposed use would be compatible with and not significantly detrimental to adjoining and/or surrounding land uses or result in adverse effects to occupiers of neighbouring premises and (B) adequate access, parking and service arrangements can be provided. It is considered that the proposal is contrary to these policies in that: a) The proposal would generate an increase in traffic movements in a restricted area that could result in obstruction of the highway and cause nuisance to the occupiers of nearby dwellings and, b) The application site is located in a quiet cul-de-sac where the introduction of a business use which involves members of the public calling at the premises has the potential to change the character of the area and have an adverse effect on the residential amenities of the occupiers of nearby dwellings.
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent a sustainable or an acceptable form of development and has been refused for the reasons set out above.
