1.No development whatsoever shall take place until full details of the appearance and landscaping of the development (herein after referred to as the reserved matters) have been submitted to and approved by the Local Planning Authority and the development shall be carried out strictly in accordance with such approved details. The reason for the condition is:- Such details have not been submitted as part of this application.
2.Application for approval of reserved matters must be made not later than the expiration of three years beginning with the date of this permission and the development must be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. The reason for this condition:- The time limit condition is imposed in order to comply with the requirements of Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
3.The development with regard to access, layout and scale shall be carried out in accordance with the details contained in the planning application forms and drawing no. 20162/2 received by the Local Planning Authority on 1st July 2016. The reason for the condition is :- For the avoidance of doubt.
4.No development shall take place until the applicant, his agent or successors in title has secured the implementation of a programme of historic building recording in accordance with a brief issued by Norfolk County Council's Historic Environment Service. The reason for the condition is :- The building is of historic interest within the Borough and should be recorded prior to demolition.
5.No works shall commence on site until such time as details of the slab levels of the dwellings in relation to existing and adjacent ground levels have been submitted to and approved by the Local Planning Authority. The dwellings shall be constructed in accordance with the slab levels as agreed. The reason for the condtion is:- To ensure that the development takes place in the manner contemplated by the Local Planning Authority and to retain control over any significant changes in levels within the site.
6.Vehicular, pedestrian and cyclist access to and egress from the adjoining highway shall be limited to the access shown on drawing no. 2016/2 only. Any other accesses or egresses shall be permanently closed and the footway/highway verge shall be reinstated in accordance with a detailed scheme to be agreed with the Local Planning Authority in consultation with the Highway Authority, concurrently with the bringing into use of the new access. The reason for the condition is :- In the interests of highway safety.
7.Notwithstanding the details indicated on the submitted drawing, no works shall commence on site (unless otherwise agreed in writing) until a detailed scheme for the off-site highway improvement works as indicated on drawing no. 2016/2 (namely access modification and closure and land dedication) has been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is :- To ensure that the highway improvement works are designed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor.
8.Prior to the first occupation of the development hereby permitted, the off-site highway improvement works referred to in condition 7 of this permission shall be completed to the written satisfaction of the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is :- To ensure that the highway network is adequate to cater for the development proposed.
9.Prior to the first occupation of the dwellings hereby permitted, the vehicular access (indicated for improvement on drawing no. 2016/2) shall be modified to a minimum width of 5 metres and provided with kerb radii of 6 metres in accordance with the Norfolk County Council residential access construction specification for the first 10 metres as measured back from the near channel edge of the adjacent carriageway. Arrangement shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway. The reason for the condition is :- In the interest of highway safety and traffic movement.
10.Notwithstanding the submitted details (unless otherwise agreed in writing by the Local Planning Authority) the proposed private drive shall be maintained in perpetuity at a minimum width of 5 metres for a minimum length of 10 metres as measured from the near edge of the highway carriageway and shall be constructed perpendicular to the highway carriageway for that said distance. The reason for the condition is :- In the interest of highway safety and traffic movement.
11.Prior to the first occupation of the development hereby permitted, the visibility splays shall be provided in full accordance with the details indicated on the approved plan (drawing no. 2016/2). The splays shall thereafter be maintained at all times free from any obstruction exceeding 1.00 metre above the level of the adjacent highway carriageway. The reason for the condition is :- In the interests of highway safety.
12.Prior to the first occupation of the development hereby permitted, the proposed access, on-site car parking and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety.
13.The dwelling on plot 5 shall be of single storey construction only and notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no dormer windows or other openings to the roofspace shall be provided without the prior consent of the Local Planning Authority. The reason for the condition is:- In the interests of the residential amenities of the occupiers of the adjacent dwelling.
14.Demolition and construction work shall not take place outside the following hours:- 07:30 to 18:00 Monday to Friday 08:00 to 13:00 Saturday and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
15.REASON FOR APPROVAL OF THE APPLICATION :- The proposals meet the criteria for new housing development set out in saved Policy HOU7 of the Great Yarmouth Borough-wide Local Plan and Policies CS1 and CS2 of the Great Yarmouth Local Plan: Core Strategy.
16.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
17.NOTES - Please read the following notes carefully:- 1) For a brief regarding the historic building recording (which will comprise a photographic survey) required by condition 4 of this permission please contact The Historic Environment Service, Union House, Gressenhall, Dereham, NR20 4DR, tel. 01362 869293. 2) It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. This development involves work to the public highway that can only be undertaken within the scope of a Legal Agreement between the applicant and the County Council. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary Agreements under the Highways Act 1980 are also obtained. Advice on this matter can be obtained from the County Council's Highways Development Management Group based at County Hall in Norwich. Please contact Developer Services on 0344 800 8020. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer. If required, street furniture will need to be repositioned at the applicant's expense. 3) This proposal involves excavations adjacent to the public highway. It is an OFFENCE to carry out any works that may affect the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council.
