| 1. | The proposal is contrary to the aims of policy CS10 of the adopted Core Strategy. Criterion A states that proposals should conserve and enhance both historical assets and their setting. It is considered that the proposed use and the subsequent proposed mitigation measures do not adequately protect the town wall which is an important historical asset to the town of Great Yarmouth. The limited distance between the scrap yard processes and the town wall means the setting is fundamentally compromised. Criterion B of policy CS10 states that proposals shall seek beneficial enhancements. This proposal will result in a worse situation as opposed to an enhancement when compared to the last approved application. Criterion C aims for improved access to ancient monuments, but the access is not deemed sufficient and again is worse than current approved. Paragraph 133 and 134 of the National Planning Policy Framework states that the public benefits should outweigh the harm. In this instance the mitigation measures are not deemed sufficient meaning the employment benefits provided by the use do not outweigh the potential damage to the town wall. In addition paragraph 137 states that the proposal should enhance the setting which this application does not. Consequently the proposal does not conform to policy due to the impact upon the historically important town wall. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
