.Notwithstanding the approved application forms the site shall only be used for car boot sales on :- a) Sundays between the hours of 10.00am and 4.00pm. b) Monday (non race days) and Thursdays (non race days) between the hours of 9.00am and 6.00pm. The reason for the condition is :- For the avoidance of doubt, to ensure the development does not adversely affect the amenities of the neighbouring properties and to ensure that the use of the site takes place in the manner contemplated by the Local Planning Authority on the grant of this permission.
.At all times during which the site is used for car boot sales suitable notices shall be prominently displayed at the front of the site informing customers that they should park their cars on the area of the racecourse to the north of the application site and not on any of the highways within the neighbouring residential areas. The reason for the condition is :- To prevent injury to the residential amenities enjoyed by the occupiers of the nearby dwellings.
.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria for car boot sales set out in Policy SHP13 of the adopted Great Yarmouth Borough-wide Local Plan.
.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
.NOTES - Please read the following notes carefully:- Notwithstanding sections 224 and 225 of the Town and Country Planning Act 1990, it is an offence under section 132 of the Highways Act 1980 to erect advertising such as pictures or signs to any trees, highways signs, structures or works or as free standing signs, etc on or within the extent of the public highways without the consent of the Highway Authority. It should be noted that such advertising can distract drivers and in this respect the road safety and amenity issues raised by these advertisements mean that is unlikely that express consent to display them would be given. The Highway Authority, may without predjudice, remove any such advertising.
