1.The application site is within a flood zone 3 area and a flood plain meaning the site has a high level of flood risk. The Environmental Agency has objected to the proposal where it is considered an inappropriate use within a flood zone 3b. The development is considered contrary to the aims of Paragraph 102 of the National Planning Policy Framework which outlines an exception test and policy CS13 of the Emerging Core Strategy (criterion A). The application does not sufficiently demonstrate that the development will be safe for its life time nor will offer an improvement in terms of flood risk. Furthermore the application has not provided sufficent detail on the foul water drainage meaning the Environmental Agency and Local Planning Authority are not satisfied that the development provides a safe and clean method of foul water disposal and an acceptable environment in accordance with paragraph 109 of the National Planning Policy Framework. Consequently, the Borough Council, as Local Planning Authority, considers that the proposal is contrary to paragraph 102 of the National Planning Policy Framework and policy CS13 of the Emerging Core Strategy. In addition the proposal is considered contrary to paragraph 109 of the National Planning Policy Framework.
2.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
