| 1. | Paragraph 102 of the National Planning Policy Framework outlines an exception test which states site specific
flood risk assessment must demonstrate that the development will be safe for its lifetime
taking account of the vulnerability of its users, without increasing flood risk elsewhere, and, where
possible, will reduce flood risk overall. The application site is within a flood zone 3 area and has not
provided a sufficient Flood Risk Assessment. The Flood Risk Assessment fails to address a number of
issues including, the safety of the occupants, extreme flood events and climate change.
The application has not demonstrated that the site will be safe for its lifetime and the provided
mitigation measures are not considered sufficient.
The development is considered contrary to policy CS13 of the Emerging Core Strategy as the
exception test is not met and an adequate flood response plan has not been received.
Furthermore satisfactory noise contamination measures has not been provided meaning the Local Planning Authority is not satisfied that the development provides a suitable residential environment.
Consequently, the Borough Council, as Local Planning Authority, considers that the proposal is
contrary to paragraph 102 of the National Planning Policy Framework and policy CS13 of the
Emerging Core Strategy. In addition the proposal is considered contrary to policy HOU15 of the
Borough Wide Local Plan in that the development does not provide a good quality environment for
the occupants. |
