| 1. | The development must be begun not later than three years beginning with the date of this permission. The siting of the barrow shall expire on the 01 October 2026 and unless on or before this date application has been made for an extension to the period of permission and such application is approved by the Local Planning Authority the barrow shall be removed from the site.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004 and to assess the impact of the proposal upon the amenities of the neighbouring uses and to ensure the barrow remains visually acceptable. |
| 2. | The development shall be carried out in accordance with the application form received by the Local Planning Authority on 13 April 2016 and the additional information received by the Local Planning Authority on 6 June 2016.

| 3. | No part of the barrow shall overhang or encroach upon highway land and no advertising signs or similar shall be erected/placed on the highway.

In the interests of highway safety. |
| 4. | No hot food shall be sold within the barrow hereby approved.
The reason for the condition is :-
To avoid a proliferation of hot food takeaways and for the amenities of neighbouring uses. |
| 5. | The use hereby permitted shall not be operational outside the following times:-
10:00 to 22:00 Monday to Sunday (including bank holidays).
When the barrow is not in use it shall be removed from the site.
The reason for the condition is :-
In the interests of visual amenity by ensuring the barrow is not left vacant. |
| 6. | The barrow hereby approved shall be positioned in accordance with the plan received on the 13 April 2016 and shall not be located outside this area without the written consent of the Local Planning Authority.
The reason for the condition is :-
In the interests of visual amenity and to avoid the barrow causing an obstruction. |
| 7. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria outlined in policy TR7 and TR21 of the Borough Wide Local Plan. |
| 8. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |
