| 1. | This permission expires on 30 September 2017 and unless on or before this date application has been made for an extension to the period of permission and such application is approved by the Local Planning Authority the use shall be discontinued and the seating removed from the site.
The reason for the condition is:-
In order to retain control over the use of the site until the effects of the proposal have been experienced and in the interest of the amenities of the locality. |
| 2. | The development shall be carried out in accordance with the application form and approved plan received by the Local Planning Authority on 04 April 2016.
The reason for the condition is :-
For the avoidance of doubt. |
| 3. | The tables and chairs shall be located within the area marked on the block plan received by the Local Planning Authority on the 04 April 2016 only and shall not be located outside of this area at any time.
The reason for the condition is :-
In the interests of clarity and to avoid a highway obstruction. |
| 4. | Notwithstanding the approved plans and prior to the commencement of the use hereby permitted full details of barriers/windbreaks as well as the their proposed siting shall be submitted to and approved by the Local Planning Authority. The barriers shall not be located outside the area marked on the block plan received by the Local Planning Authority on the 04 April 2016. The barriers shall be carried out in accordance with the approved details and in situ in the approved position whilst the seating area is in use.
The reason for the condition is :-
To ensure the area is clearly marked and the barriers are of an acceptable design. |
| 5. | All equipment shall be removed from the site and stored securely off the highway outside the hours of 11:00 am to 20:00 pm in any day or when the associated business is not in use.
The reason for the condition is :-
In the interests of visual amenity and hgihway safety. |
| 6. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria outlined in saved policy TR21 of the Borough Wide Local Plan and polciies CS8 and CS9 of the adopted Core Strategy. |
| 7. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |

The siting of a seating area may require a licence.
The applicant should sign up to the Environmental Agency Flood Line.
The applicant should be mindful of the landau route adjacent and should avoid either causing an obstruction or creating a fright risk. |
