No.Condition Text
1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form and the revised plan received by the Local Planning Authority on 5 July 2016. The reason for the condition is :- For the avoidance of doubt.
3.No works shall commence on site until such time as details of the slab levels of the dwelling in relation to existing ground levels have been submitted to and approved by the Local Planning Authority. The dwelling shall be constructed in accordance with the agreed levels. The reason for the condtions is:- To ensure that the development takes place in the manner contemplated by the Local Planning Authority and to retain control over any significant changes in levels within the site.
4.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Monday to Friday 08:30 to 13:30 Saturday and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
5.No work shall commence until the exact types and colours of the materials, including the hard surfaces have been submitted to and approved by the Local Planning Authority. The development shall be carried out using the agreed materials. The reason for the condition is :- In the interests of the visual amenities of the area as precise details of the materials have not been submitted.
6.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting the order) no extensions shall be built or windows inserted into the walls or roof of the building without the prior consent of the Local Planning Authority. The reason for the condition is:- In the interests of the residential amenities of the occupiers of the adjacent property.
7.The existing Vehicular access (off Howard Street South) shall be permanently closed and the footway shall be reinstated in accordance with a detailed scheme to be agreed with the Local Planning Authority in consultation with the Highway Authority, concurrently with the bringing into use of the new access. The reason for the condition is :- In the interests of highway safety.
8.Prior to occupation of the dwelling hereby approved the yard are shall be completed and made available for bin storage. The bins associated with the dwelling shall be stored in the yard shown on the approved plans in perpetuity. The reason for the condition is :- In the interests of enhancing the street scene and to avoid unneccessary obstacles.
9.No demolition/development shall take place/commence until a Written Scheme of Archaeological Investigation has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and 1. The programme and methodology of site investigation and recording 2. The programme for post investigation assessment 3. Provision to be made for analysis of the site investigation and recording 4. Provision to be made for publication and dissemination of the analysis and records of the site investigation 5. Provision to be made for archive deposition of the analysis and records of the site investigation 6. Nomination of a competent person or persons/organization to undertake the works set out within the Written Scheme of Investigation The reason for the condition is :- To preserve items of historical and archaeological importance as the site is within an area of high archaeological importance.
10.No demolition/development shall take place other than in accordance with the Written Scheme of Investigation approved under condition 9. The reason for the condition is :- To preserve items of historical and archaeological importance as the site is within an area of high archaeological importance.
11.The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition 9 and the provision to be made for analysis, publication and dissemination of results and archive deposition has been secured. The reason for the condition is :- To preserve items of historical and archaeological importance as the site is within an area of high archaeological importance.
12.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria
13.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
14.This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Development Management Group. Please contact Developer Services on 0344 800 8020. If required, street furniture will need to be repositioned at the applicant's expense. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
