| 1. | Saved Policy HOU7 of the Borough Wide Local Plan (criterion C) states that residential developments must have a suitable access whilst criterion E states that a development must not be significantly adverse to the amenities of both the neighbours and the users of the land. The proposed development contains an access road which is positioned directly adjacent to the donor property which creates an unsuitable layout. The access will serve three additional properties and the donor property meaning the significant increase in associated vehicle movements will pass unacceptably close to the donor property creating an adverse level of noise and disturbance to the occupier of the donor property. In addition the access in conjunction with the increased traffic movements will increase the potential for damage to the donor property. The inappropriate access is also considered contrary to the aims of policy CS9 (criterion D) of the adopted Core Strategy. The layout is considered unacceptable particularly as it is a form of back land development which does not conform to the existing street pattern. Plot 15C appears contrived and does not sufficiently relate to the other properties creating a form of development which is contrary to saved policy HOU17 of the Borough Wide Local Plan. Consequently the application is considered contrary to saved policies HOU07 and HOU17 of the Borough Wide Local Plan and policy CS9 of the adopted Core Strategy. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
