1.Saved Policy SHP4 of the Great Yarmouth Borough-Wide Local Plan states that proposals for the change of use from use Class A1 to use Classes A2 and A3 in primary and secondary shopping frontages shown on the proposals map will be acceptable providing the proposal would not be significantly detrimental to the appearance of the shopping frontage or the amenity of adjoining occupiers, it would not result in creation of a concentration or predominance of non-retail (Class A2 or A3) uses which would detract from the vitality and viability of the frontage and the proposal would not undermine the retail function of the frontage. The application site is within a part of the High Street where there are a number of non-retail uses and the loss of this existing retail unit and its use as a cafe/gaming centre would result in a predominance of non-retail uses which would detract from the vitality and viability of the frontage and undermine the retail function of the area. It is therefore considered that the proposal is contrary to the aims of saved Policy SHP4 of the Great Yarmouth Borough-Wide Local Plan. Policy CS7 of the Local Plan: Core Strategy aims to improve the vitality and viability of town centres by safeguarding the retail function and character of each centre and enhance the appearance, safety and environmental quality of the centres. Although the building is currently empty the change of use of this unit would result in a loss of retail premises that would have an adverse effect on the retail function of the area. There are existing betting offices and a gaming centre in the High Street and any additional betting/gaming use would have an adverse effect on the shopping frontage and the character of the area.
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
