1.The application site is outside of the any area in the adopted Great Yarmouth Borough Wide Local Plan where residential development might be permitted. Outside of these defined areas Policy HOU10 of the Great Yarmouth Borough Wide Local Plan states that permission for new dwellings in the countryside will only be given in connection with agriculture, forestry, organised recreation or the expansion of existing institutions. No need for the dwelling has been demonstrated to satisfy the criteria of the above policy.
2.The location of the proposed new dwelling in the open countryside is not a sustainable one and the application is therefore contrary to the overriding objective of the National Planning Policy Framework which promotes sustainable development and, given the isolated location, the development proposed is contrary to paragraph 55 of the National Planning Policy Framework. The unsustainable location, coupled with a development which is out of character and keeping with the local settlement and landscape is contrary to policy CS1 of the adopted Core Strategy.
3.Policy HOU20 defines the criteria which replacement dwellings in the countryside are allowed. The current application does not seek to replace an existing habitable dwelling and as such is contrary to policy HOU20(a) of the Borough Wide Local Plan. The location of the proposed dwelling is not in a similar location to the existing barn and would therefore be contrary to policy HOU20(d) should it be able to be assessed against it. The location of the proposed new dwelling would be set back into the open countryside which would have a significantly adverse effect on the setting and the character of the area by placing a new domestic building in an isolated location. The development proposed, given the prominent position, would be contrary to policy CS11 of the adopted Core Strategy which seeks to protect and enhance areas designated as important to the setting of settlements and prevent urban sprawl.
4.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
