| 1. | Policy HOU17 of the Borough Wide Local Plan requires all new properties resulting from the subdivision of land to have regard to the density and character of the surrounding area. This proposal is for a new property within the rear garden of an existing dwelling. The proposed property is considered out of character with its surroundings as it is positioned behind the existing residential frontage of Penguin Road and results in the loss of garden space within an area characterised by large gardens and open rear landscapes. The resultant development is a form and character unsympathetic to its surroundings and contray to policy HOU07 and HOU17. In addition there is insufficient amenity space for the proposed and donor property which is not only unsympathetic to the character of the area, but also reduces the quality of the environment for the donor property constituting an overdevelopment of the site. In addition the proposal will require a long access route between two properties and the resultant traffic movements will detract from the residential amenities of the neighbouring properties in terms of noise and activity which is contrary to policy HOU7. Consequently, the Borough Council, as Local Planning Authority, considers that the proposal is contrary to policy HOU07 and HOU17 of the adopted Borough-Wide Local Plan and policy CS9 of the Core Strategy. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
