1.The application is a change of use from a workshop/store to a residential property. The application site is within flood zone 3. The application has not provided sufficient information for the Local Planning Authority to be satisfied that the site will be safe for its lifetime. The Flood Risk Assessment fails to provide details on the finished floor levels meaning it is not possible to ascertain the depth of any flooding within the building. The development is considered contrary to policy CS13 of the Emerging Core Strategy as the exception test is it has not been demonstrated that the new dwelling is safe. Consequently, the Borough Council, as Local Planning Authority, considers that the proposal is contrary to paragraph 102 of the National Planning Policy Framework and policy CS13 of the Core Strategy.
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
