1.The application site is located outside of the village development limits of Fleggborough and is not adjacent these limits, as such the Interim Housing Land Supply Policy does not apply. HOU10 of the Borough Wide Local Plan seeks to prevent development outside of the development boundaries other than in exceptional cases; no attempt has been made to comply with policy HOU10 and as such the development as proposed is contrary to current policy. Paragraph 55 of the National Planning Policy Framework, in accordance with HOU10 restricts the development outside of development limits to exceptional circumstances which have not been met, the development, in an unsustainable location, is therefore contrary to the National Planning Policy Framework and CS1 of the adopted Core Strategy.
2.The layout of the proposed development is not in keeping with the character, form or layout of the village and as such would have an adverse effect on the existing landscape. The overdevelopment of the site compounds the significant adverse effects of the development as proposed contrary to policy CS1 of the Core Strategy. The number and size of the dwellings proposed constitute an over development of the site which would lead to a development which is out of keeping with the character and scale of the surrounding area contrary to policy HOU17 of the Borough Wide Local Plan.
3.The location of properties has not taken into account the trees which adjoin the site. The woodland on the adjoining land is of benefit to the village and surrounding development and could suffer adverse effect by the proposed development. The design of the location and scale of the proposed development has not adequately considered the trees which could cause detriment to the future occupiers of the development and the existing trees.
4.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
