| 1. | Policy HOU07 and HOU15 of the Borough Wide Local Plan requires all new dwellings to relate satisfactorily to its surroundings in terms of the relationship the new dwelling will have with the neighbouring properties. This proposal is for a new two storey structure which contains two flats. The site is within a dense urban area with properties situated to the south east and north west. Within a constrained site this development would adversely affect the adjacent residential properties by virtue of overlooking and overshadowing. The proposal and the neighbouring flats are separated by a narrow row meaning the ground floor flats at 151 King Street would have a new structure positioned close to its existing windows resulting in a significant loss of outlook and light resulting in a detrimental environment for the occupiers. Consequently, the Borough Council, as Local Planning Authority, considers that the proposal is contrary to policies HOU07 (criteria E) and HOU15 of the adopted Borough-Wide Local Plan. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
