No.Condition Text
.The rear elevation of the proposed extension would include two first floor windows, which would be sited approximately only 5 metres and 8 metres from the neighbouring rear garden with No.4 Freeman Close. By reason of its siting and the close proximity of the first floor windows to the neighbouring rear garden, the proposed extension would create a signficant detrimental affect on the residential amenity of No.4 Freeman Close by increasing overlooking and loss of privacy to the rear garden of this property to an unacceptable level. The proposal is therefore contrary to part (ii) of Policy HOU18.
.The 7 metre high (5.2 metres at the eaves), two storey element of the proposed extension would be sited 1m from the neighbouring boundary with No.3 Freeman Close, projecting 4.3 metres in depth adjacent to this neighbouring boundary. By reason of its height, scale and siting within close proximity to the neighbouring boundary with No.3 Freeman Close, the proposed two storey element would create a significant overbearing impact, overshadowing and loss of sunlight to the conservatory and part of the rear garden of this neighbouring property. The proposal is therefore contrary to part (ii) of Policy HOU18.
.By virtue of its height, depth and overall scale, the proposed extension appears out of proportion with the scale and design of the existing dwelling and out of character with the neighbouring dwellings and surrounding area. The proposal is therefore contrary to part (i) of Policy HOU18.
.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
