| 1. | The application site is located outside of the village development limits specified within the Great Yarmouth Borough-Wide Local Plan Proposals Map where development might be permitted. Policy HOU10 of the Great Yarmouth Borough-Wide Local Plan 2001 states that permission for new dwellings in the countryside will only be given if required in connection with agriculture, forestry, organised recreation, or the expansion of existing institutions. Policy HOU10 provides specific criteria relating to this which should be met. No evidence has been provided with the planning application which would satisfy the relevant criteria within the above policy and therefore it is considered that the proposal is contrary to Policy HOU10 and relevant guidance the National Planning Policy Framework which does not support the erection of isolated new dwellings in the countyside in unsustainable locations. It is not possible to assess whether the proposed dwelling would fulfil the requirements of paragraph 55 of the National Planning Policy Framework as the application seeks outline planning permission for access and layout only. |
| 2. | The application site is located within an area defined on the proposals map as Landscape Important to the Setting of Settlements, where Policy NNV5 of the Great Yarmouth Borough-Wide Local Plan 2001 applies. Policy NNV5 aims to protect the setting of settlements and prevent urban sprawl by only permitting development in the areas around settlements shown on the proposals map as Landscape Important to the Setting of Settlements where the developer can demonstrate essential need or that the development would not give rise to any significant adverse impact. The applicant has not submitted any evidence to suggest there is an essential need and it is considered that the proposal would give rise to significant adverse impacts by virtue of its location, where it would increase pressure for further development which impinges on the physical separation between settlements and would detract from the mainly rural character of the area. For these reasons, the proposal is considered to be contrary to Policy NNV5 of the Borough-Wide Local Plan. |
| 3. | The application site is located within Flood Zones 2 and 3. Paragraph 101 of the National Planning Policy Framework states that development should not be allocated or permitted if there are reasonably available sites appropriate for the proposed development in areas with a lower probability of flooding. The proposal fails the Sequential Test for flooding as there are reasonably available sites appropriate for the proposed development within the development limits and with a lower risk of flooding. The information provided within the Flood Risk Assessment (8.0 of the Design and Access Statement) is considered by the Environment Agency to be insufficient. The proposal is therefore contrary to flooding guidance within the National Planning Policy Framework. |
| 4. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
