1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the details contained in the planning application forms and drawing no's. 1342-A-PL05 rev A, 1342-A-PL06 rev C, 1342-A-PL07, 1342-A-PL08, 1342-A-PL09, 1342-A-PL10, 1342-A-PL11 and 1342-A-PL12 received by the Local Planning Authority on 28th May 2015. The reason for the condition is :- For the avoidance of doubt.
3.No work shall commence until the exact type and colour of the facing bricks and roof tiles have been submitted to and approved by the Local Planning Authority. The buildings shall thereafter be constructed using the agreed materials. The reason for the condition is :- In the interests of the visual amenities of the area as precise details of these materials have not been submitted.
4.No development shall take place until a surface water drainage scheme for the site, based on sustainable drainage principles, has been submitted to and approved in writing by the Local Planning Authority. The scheme shall subsequently be implemented in accordance with the approved details before the dwellings are first occupied. The reason for the condition is :- In order to effect satisfactory drainage arrangements on the site.
5.Before the development is commenced a scheme of planting and landscaping, which shall include indications of all existing trees and hedgerows, shall be submitted for the approval of the Local Planning Authority. The planting of trees and shrubs shall be carried out in accordance with the scheme as approved prior to the first occupation of the dwellings. Any trees and shrubs so planted which die within 3 years shall be replaced within one year by the applicants or their sucessors in title. The reason for the condition is:- To enhance the visual amenities of the locality.
6.Notwithstanding the details indicated on the submitted drawings no works shall commence on site, unless otherwise agreed in writing, until a detailed scheme for the off-site highway improvement works (access and footway tie-in) as indicated on drawing number 1342-A-PL06 Rev. C have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is :- To ensure that the highway improvement works are designed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor.
7.Prior to the first occupation of the development hereby permitted, the off-site highway improvement works referred to in condition 6 of this permission shall be completed to the written satisfaction of the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is :- To ensure that the highway network is adequate to cater for the development proposed.
8.Notwithstanding the submitted details, unless otherwise agreed in writing by the Local Planning Authority, the proposed private drive shall be maintained at a minimum width of 5 metres for a minimum length of 10 metres as measured from the near edge of the highway carriageway and shall be constructed perpendicular to the highway carriageway. The reason for the condition is :- In the interest of highway safety and traffic movement.
9.Prior to the first occupation of the development hereby permitted, a visibility splay shall be provided in full accordance with the details indicated on the approved plan. The splay shall thereafter be maintained free from any obstruction exceeding 0.225 metres above the level of the adjacent highway carriageway. The reason for the condition is :- In the interests of highway safety.
10.Prior to the first occupation of the development hereby permitted, the proposed access, on-site car parking and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring areas, in the interests of highway safety.
11.The existing finger post direction sign for the church shall be re-erected in a location to be agreed with the Local Planning Authority in consultation with the Highway Authority and Filby Parish Council. The reason for the condition is :- To ensure that the direction sign remains in place.
12.Construction work shall not take place outside the following hours:- 07:30 to 18:00 Monday to Friday 08:30 to 13:30 Saturday and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
13.No work shall commence on the development hereby permitted until tree protection works have been put in place in accordance with the details contained in the Arboricultural Impact Assessment and drawing no. OAS/ 1558-TS01 submitted with the application. The protection works shall be maintained and remain in place until the development is complete. The reason for the condition is :- To ensure that the trees near the site are not harmed during the course of construction.
14.Except where removal is necessary to allow construction of the new vehicular access, the existing hedge along the front of the application site shall be retained. The reason for the condition is :- In the interests of the visual amenities of the locality.
15.REASON FOR APPROVAL OF THE APPLICATION :- The proposal complies with the Interim Housing Land Supply Policy and is in line with the aims of the National Planning Policy Framework.
16.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
