No.Condition Text
1.Condition 3 of planning application 06/14/0365/F limited opening until 22:00 Monday to Saturday and 21:00 Sundays and Bank Holidays. This condition was imposed in interests of the residential amenities of the occupiers of nearby property. The proposed variation of condition would extend the opening hours until 01:00 in the morning for all seven days the week with additional 24 hours opening for bank holidays. The late opening is considered to be unreasonable to the nearby properties resulting in a significant loss of amenities in terms of noise and people movements. Consequently, the Borough Council, as Local Planning Authority, considers that the proposal is contrary to paragraph 123 of the National Planning Policy Framework and policy SHP15 of the Borough Wide Local Plan.
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
