| 1. | Policy TCM13 of the Borough Wide Local Plan requires all developments to be safe to users of public highways and not create hazards or limit the functioning of local highway networks. Beach Road is an important route that connects the beach and other shopping and tourism uses. The external covered shop display areas are proposed to open out into the public highway which has the potential to obstruct the public highway forming an inconvenience to the highway users and a potential hazard. One of the display areas will encroach upon highway land further forming an obstruction.
As the proposal will cause an obstruction it will result in an inconvenience and potential hazard. Consequently, the Borough Council, as Local Planning Authority, considers that the proposal is contrary to policy TCM13 of the adopted Borough-Wide Local Plan.

| 2. | Policy SHP8 of the Borough Wide Local Plan requires all development to avoid an overdevelopment of the site, to maintain access and to not give rise to traffic congestion. Further to this policy SHP8 requires development to be in keeping with the surrounding character. The development will result in an obstruction which will negatively affect the access and likely lead to traffic congestion.
One of the covered display areas extends outside the covered shop area resulting in a development out of character with its surroundings.
Consequently, the Borough Council, as Local Planning Authority, considers that the proposal is contrary to policy SHP8 of the adopted Borough-Wide Local Plan.
