No.Condition Text
1.APPROVAL IN PART of condition(s): Condition 6 states - Prior to commencement of the development details of the means of ventilation and extraction are to be submitted to and approved by the Local Planning Authority. The details are to include details of the method of construction, odour control and noise levels. The ventilation and extraction system shall be fitted as approved and retained in perpetuity unless otherwise agreed in writing by the Local Planning Authority. The reason for the condition is :- In the interests of the amenities of neighbouring residential properties" On 19 November 2015 the Council's EHO recommended the discharge of condition 6 in terms of odour control but not noise which required further assessment. A subsequent planning permission to vary application 06/14/0277/F did not carry through the means of ventilation and extraction condition, however, under application 06/17/0322/F, the plans were amended to include sound insulation cladding that is currently in situ on the external flue which had been subject to previous noise complaints prior to the sound insulation being installed. Comments from EH stated that the sound insulation should not be changed or altered given the proximity to the neighbouring properties. This permission was granted subject to the following condition: The ventilation stack shall remain as existing in accordance with the approved plans received on the 10th July 2017 reference drawing number 1730-001 A in perpetuity. No sound insulation shall be removed or altered in any way. In summary, the second part of condition 6 relating to noise has been superseded and further details have satisfactorily resolved this issue. Accordingly, this condition can be discharged in so far as it relates to odour control only and is therefore discharged in part.
