No.Condition Text
1.The intensification of the existing use would result in an unacceptable risk to public safety which is contrary to policies TR1 and TR2 of the Borough Wide Local Plan. The increased use of an access which falls below the standards set out in the Transport Guidance 'Manual for Streets' does not safeguard the community interests as allowing the use of an unsafe access is detrimental to the safety of the public. The access to the land is reached over a private road which is not in the control of the applicant. The intensification in use of this land by persons accessing the site year round would put an unacceptable burden on a third party.
2.The character of the area would be altered to the detriment of the amenities of the local residents by the intensification of the use of the site during the winter months. The additional noise, light and traffic accessing the site would cause a disturbance to residents outside of the months that the use has traditionally operated.
3.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
