1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the details contained in the planning application forms received on 18th June 2014 and the revised drawings 1402-011, 1402-012, 1402-013, 1402-014, 1402-015 and 1402-016 received by the Local Planning Authority on 20th August 2014. The reason for the condition is :- For the avoidance of doubt.
3.No works shall commence on site until such time as details of the slab levels of the dwellings in relation to existing ground levels have been submitted to and approved in writing by the Local Planning Authority. The dwellings shall be constructed in accordance with the slab levels as agreed. The reason for the condition is :- To ensure the development takes place in the manner contemplated by the Local Planning Authority and to retain control over any significant changes in levels within the site.
4.Construction work shall not take place outside the following hours:- 07:30 to 18:00 Monday to Friday 08:00 to 13:00 Saturday and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
5.Notwithstanding the provisions of the Town & Country Planning (General Permitted Development) Order 1995 (or any other Order revoking or re-enacting that Order) no windows or other openings (except those shown on the approved drawings) shall be inserted at first floor level or above in any of the elevations of the dwellings hereby permitted unless planning permission has first been granted by the Local Planning Authority. The reason for the condition is :- In the interests of the amenities of the occupiers of nearby dwellings.
6.Prior to the first occupation of the dwellings hereby permitted, the vehicular accesses shall be provided and thereafter retained in the positions shown on the approved plan in accordance with the highway specification (Dwg. No. TRAD 1) attached. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway. The reason for the condition is :- To ensure satisfactory access into the site and avoid carriage of extraneous material or surface water from or onto the highway.
7.The gradient of the vehicular accesses shall not exceed 1:12 for the first 5 metres into the site as measured from the near channel edge of the adjacent carriageway. The reason for the condition is :- In the interests of the safety of persons using the accesses and users of the highway.
8.Notwithstanding the provision of Class A of Schedule 2, Part 2 of the Town and Country Planning (General Permitted Development) Order 1995, (or any Order revoking, amending or re-enacting that Order) no gates, bollard, chain or other means of obstruction shall be erected across the approved accesses unless details have first been submitted to and approved in writing by the Local Planning Authority. The reason for the condition is :- In the interests of highway safety.
9.Prior to the first occupation of the dwellings hereby permitted, a visibility splay shall be provided in full accordance with the details indicated on the approved plan (1402-016). The splay shall thereafter be maintained at all times free from any obstruction exceeding 0.6 metres above the level of the adjacent highway carriageway. The reason for the condition is :- In the interests of highway safety.
10.Prior to the first occupation of the dwellings hereby permitted, the proposed accesses and on-site car parking and turning areas shall be laid out, surfaced and drained in accordance with details to be submitted to and approved by the Local Planning Authority. The parking and turning areas shall be retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring areas, in the interests of highway safety.
11.No piling shall take place without the prior approval of the Local Planning Authority as to the method to be used. If agreed, no piling shall take place outside the following hours:- 08:30 to 17:00 Monday to Friday 09:00 to 13:00 Saturday and no piling shall take place on Sundays or Bank Holidays. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
12.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria of Policy HOU15 of the adopted Great Yarmouth Borough Wide Local Plan.
13.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
14.NOTES - Please read the following notes carefully:- This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Development Management Group. Please contact Stuart French on 0344 800 8020. If required, street furniture will need to be repositioned at the applicant's expense. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
