No.Condition Text
.Given the location of the site in close proximity to the River Yare the proposed development for residential purposes is considered an inappropriate location for new residential development in that it is adjacent to sites engaged in port activities on port operational land where there is 24 hour working and if permitted would not afford the standard of residential amenity normally expected for new dwellings by virtue of late night noise and general disturbance. The proposal is therefore considered contrary to Policy HOU15 of the Adopted Great Yarmouth Borough-Wide Local Plan in that it has not been shown that the accommodation could be provided with an adequate standard of residential amenity and the National Planning Policy Framework as the site is not considered a sustainable location.
.The outline submission with all matters reserved for future approval does not provide sufficient information to adequately assess the impact of the proposed development on the adjoining residental property together with the impact of the overall scale of the proposed three storey buildings on Conservation Area No.17 as all the submitted elevational drawings are for illustrative purposes only and do not show the existing adjoining development.
.The site has previously been in a commercial use and it is the responsibity of the applicant for ensuring that a development is safe and that the land is suitable for the use intended, or can be made so through remediation. In this case no information has been provided to satisfy the Local Planning Authority that risks from contamination will be appropriately addressed and therefore the proposal is considered contrary to the National Planning Policy Framework and accompanying guidance.
.Based on the description of the development proposed with one two bedroom, two four bedroomed terraced houses and 4 three bedroomed maisonettes the Council's current parking standards the minimum provision should be 15 spaces and given the restricted nature of the site insufficient parking provision could be made in particular, given the four bedroomed terrace houses proposed. Furthermore any parking provision on the site would be located adjacent to the highway pavement and if provided in garages would have severely restricted levels of visibility, similarly there is no visibility afforded to pedestrians who may be using the footway fronting the development. Additionally no information has been included within the proposal in relation to cycle parking provision and taking account that the development is accessible to local service appropriate provision should be included, in order to encourage modal shift to alternate modes of transport especially for local trips. The proposal is therefore considered in highway terms to have inadequate parking provision (both vehicle and cycle), the lack of visibility and manoeuvering area, which will be detrimental to the safety of other highway users on Riverside Road contrary to Policy TCM13 and TCM17 of the Great Yarmouth Borough-Wide Loacal Plan
.STATEMENT of Positive Engagement:In accordance with the National Planning Policy Framework, in determinatiing this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achive the aim of approving sustainable development. Unforntunately, despite this, in this paricular case the development is not considered to represent sustainable development and has been refused for the reasons set out above.
