| 1. | REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria of policy HOU23 of the adopted Great Yarmouth Borough Wide Local Plan. |
| 2. | NOTES - Please read the following notes carefully:- The submitted plans appear to show that the property has been inadvertantly converted into a house in multiple occupation (HMO). this is based on the assumption that both second floor flats will be rented out to a minimum of two unrelated persons and the ground floor and first floor accommodation labelled as 'private' is to be occupied by the owner and his/her immediate family. Neither the private accommodation on the ground and first floors or the two flats on the second floor appear to be wholly self-contained. The submitted plans indicate that the two flats on the second floor share a bathroom and WC. As an HMO offering privately rented accommodation the Housing Act 2004 and regulations made thereunder apply. If 5 or more persons forming 2 or more households occupy this property then it will fall into the mandatory HMO licensing criteria (NB: If the owner resides in the property then the owner and his/her immeidate family count as one person for the purposes of HMO licensing). The property owner is advised to consult the Borough Council's Environmental Health team as to familiarise him/herself with the obligations that the relevant legislation places upon him/her. FIRE SAFETY. If the internal layout is to remain as per the submitted plans and the property remains as an HMO then the following fire safety measures are to be installed if not already present: - The property is to be equipped with a Grade A:LD2 automatic fire detection and warning system; - The central staircase that runs through the building is to ne a protected means of escape capable of providing a minimum of 30-minutes fire and smoke resistance. This can be achieved by the walls, floors and ceilings being of good, sound construction and every risk room being fitted with a full FD30S-type fire door-set. |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |
