1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The change of use hereby approved shall be carried out in accordance with the application form, plans and Design & Access statement recevied by the local planning authority on 10th October 2013 unless first agreed in writing. The reason for the condition is :- For the avoidance of doubt.
3.Prior to the commencement of the nightclub, a noise impact and attenuation survey shall be carried out and submitted to the local planning authority, in consultation with Environmental Health, for approval. This survey shall include provision for sound attenuation against internally generated noise to ensure that the combined noise level from activities and plant in the building does not cause nuisance to neighbouring residents. The development shall be carried out in accordance with the details as approved. The noise level from activities and plant from the building should not exceed noise rating curve 25 (NR25) 23:00 hours to 07:00 hours and a noise rating curve of NR35 between 07:00 hours and 23:00 hours. This is especially the case for the adjoining residential flats as they are most likley to be affected by noise breakout from the nightclub. Noise rating curves need to be assessed as a 15 minutes linear Leq at the octave band centre frequencies 31.5 Hzto 8kHz All works that form part of the approved shceme need to be completed before commencment of the development hereby approved. The reason for the condition is :- For the avoidance of doubt and to ensure that noise is sutably address in order to protect the amenities of adjacent residents.
4.The use of the building shall not take place outside the following hours: A4 Use - 11:00 hour to 04:00 hours Monday to Sunday Sui Generis (Nightclub) - 11:00 hours to 04:00 hours Monday to Sunday A1 (shop Unit) - 08:00 hours to 22:00 hours Monday to Sunday The reason for the condition is :- For the avoidance of doubt.
5.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the provisions of the adopted Great Yarmouth Borough Wide Local Plan and, in particular, policies BNV5, BNV6, BNV7, BNV10, SHP14, TR2, TR5 & TR22 as it is an acceptable re-use of a listed building within a defined tourist area.
6.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
