No.Condition Text
.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
.The development shall be carried out in accordance with the revised drawings 13-1-1154 NPS-DR-A-15 Rev F and 13-1-1154 NPS-DR-A-16 Rev P3 received by the Local Planning Authority on 12th September 2013 and drawing 13-1-1154 NPS-DR-A-17 Rev P2 received on 22nd July 2013. The reason for the condition is :- For the avoidance of doubt.
.Prior to the first occupation of the dwellings hereby permitted, the vehicular access to the additional parking area shall be provided and thereafter retained in the position shown on the approved plan (drawing no. 13-1-1154 NPS-DR-A-15 Rev F) in accordance with the highway specification (Dwg. No.TRAD 1) attached. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway. The reason for the condition is :- To ensure satisfactory access into the site and avoid carriage of extraneous material or surface water from or onto the highway.
.Prior to the first occupation of the dwellings hereby permitted, the proposed access and on-site car parking areas shall be laid out and demarcated in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety.
.Other than the spaces numbered Plot 1 and Plot 2 parking shown on the approved drawing there shall be no restriction on the use of the remaining car parking spaces by occupiers of, or visitors to, any of the dwellings hereby permitted. The reason for the condition is :- To minimise the potential for on-street parking and thereby safeguard the interest of safety and convenience of road users.
.No works shall commence on site until such time as a Stopping Up Order to remove all highway rights subsisting in the highway land coloured green on the attached plan has been granted and all highway rights over the green coloured land have been successfully removed. The reason for the condition is :- To allow the development to proceed without obstruction of an existing highway.
.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting the order) no extensions to the dwellings hereby permitted shall be built without the prior consent of the Local Planning Authority. The reason for the condition is:- In the interests of the residential amenities of the occupiers of the adjacent property.
.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting the order) no windows or other openings (except those shown on the approved drawings) shall be inserted into the walls or roof of the dwellings without the prior consent of the Local Planning Authority. The reason for the condition is:- In the interests of the residential amenities of the occupiers of the adjacent property.
.The windows to the north and south elevations of the dwellings hereby permitted shall be obscure glazed prior to the first occupation of the dwellings and shall be retained as such thereafter. The reason for the condition is:- In the interests of the residential amenities of the occupiers of the adjacent property.
.Except for the tree shown as 'to be removed' on drawing no. 13-1-1154 NPS-DR-A-15 Rev F, the existing trees on the site shall not be felled or damaged in any way. The trees/hedging on the east boundary of the site shall be retained and shall not be removed without the prior consent in writing of the Local Planning Authority. The reason for the condition is:- The existing trees represent an important visual amenity which the Local Planning Authority consider should be substantially maintained.
.The fences shown on the approved drawing shall be erected before the dwellings to which they relate are occupied. The reason for the condition is:- In the interests of the visual amenities of the locality.
.REASON FOR APPROVAL OF THE APPLICATION :- The proposals meet the criteria for new housing development set out in Policies HOU7, HOU15, HOU16, HOU17 and TCM17 of the Great Yarmouth Borough-wide Local Plan.
.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
.NOTES - Please read the following notes carefully:-
.This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Development Management Group. Please contact Stuart French on 0344 800 8020. If required, street furniture will need to be repositioned at the applicants own expense. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
.The imposition of condition 6 does not in any way infer that Norfolk County Council, as Local Highway Authority, will support a formal application for a Stopping Up Order to remove highway rights. In addition, statutory undertakers have a right to object to the granting of a Stopping Order, which may prevent this development from progressing in its current format.
