1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development hereby permitted shall be carried out in accordance with the following approved plans: Location Plan scale 1:2500, Site Details and planting Drawing No.C.0465_04-B, Solar Panel detail Drawing C.0465_07A, Cross Section Drawing C.465.05A,Security fencing detail C.0465_06A,GRP enclosure Drawing 101.
The reason for the condition is :-
For the avoidance of doubt and in accordance with the submitted and approved documentation. |
3. | Notwithstanding Condition 2, the height of the panels and structures shall not exceed 1.6m metres above the existing ground level and the solar panels shall only be located in accordance with the approved drawings and no solar panel or structure shall be erected within the zone of the gas pipeline shown on the approved plans unless agreed in writing by the local planning authority.
The reason for the condition is :-
In accordance with the submitted details and to minimise the impact of the development on the landscape and to control development within the vicinity of the gas pipe line.

4. | All planting comprised in the approved details of landscaping shall be carried out concurrently with the erection of the solar farm and structures or the first planting season following the commencement of development and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. Where indicated on the approved plans all hedging and trees shown to be retained shall not be removed without the prior approval of the local planning aothority and an agreed schedule of replacement planting being in place and the height of the hedging shall be maintained at the minlmum height shown on the approved plans.

In the interests of the visual amenities of the locality.

5. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no fencing or means of enclosure shall be erected other than that which has been expressly authorised pursuant to Condition 2 above.

6. | Construction shall be carried out in accordance with the Construction Method Statement submitted with the application dated and received by the local planning authority on 16th April 2013 subject to the conditions set out in this planning permission.

7. | Decommissioning of the solar farm shall be carried out in accordance with the Decommissioning Statement submitted with the application on 16th April 2013 and timescales therein for decommissioning and removal of all operational equipment associated with the solar farm at the approved period operational period. Should the solar farm cease to be operational prior to the end of the approved time period then the stated measures to secure the removal of panels, plant, fencing and equipment for returning the land back to full agricultural use shall be implemented within 6 months of the cessation of the solar farm. .
The reason: In accordance with the submitted details and to ensure that the land is reinstated in accordance with good agricultural practise and because this approval is time limited.

8. | The planning permission hereby granted is for a period from the date of this decision until July 31st 2039 ( including the Construction and Decommissioning period) when the use shall cease and the solar panels and all ancillary equipment shall be removed from the site in accordance with the approved Decommissioning Method Statement.

In accordance with the terms of the application and projected lifetime of the development. |
9. | Development shall not commence until a scheme detailing provision for on site parking for construction workers for the duration of the construction period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented throughout the construction period.
Reason: To ensure adequate off-street parking during construction in the interests of highway safety.

10. | Prior to the commencement of any works a Construction Traffic Management Plan and Access Route which shall incorporate adequate provision for addressing any abnormal wear and tear to the highway shall be submitted to and approved in writing with the Local Planning Authority in consultation with Norfolk County Council Highway Authority together with proposals to control and manage construction traffic using the 'Construction Traffic Access Route' and to ensure no other local roads are used by construction traffic.
Reason: In the interests of maintaining highway efficiency and safety.

11. | No development shall take place until the applicant or their agents or successors in title has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation including a timetable which has been previously submitted to and approved in writing by the local planning authority.
A) No development shall take place/commence until a Written Scheme of Investigation has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and
1. The programme and methodology of site investigation and recording
2. The programme for post investigation assessment
3. Provision to be made for analysis of the site investigation and recording
4. Provision to be made for publication and dissemination of the analysis and records of the site investigation
5. Provision to be made for archive deposition of the analysis and records of the site investigation
6. Nomination of a competent person or persons/organization to undertake the works set out within the Written Scheme of Investigation
B) No demolition/development shall take place other than in accordance with the Written Scheme of Investigation approved under condition (A).
C) The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision to be made for analysis, publication and dissemination of results and archive deposition has been secured.
The Historic Environment Service will provide a brief for these works on request.

12. | No external artificial lighting shall be installed.
The reason for the condition is :- To protect the visual amenity of the area. |
13. | Unless otherwise approved in writing in advance by the local planning authority no construction or decommissioning works shall take place except between the following hours: 0800 to 1800 Monday to Friday, and 0800 to 1300 Saturday. No construction or decommissioning works shall take place at any time on Sunday or a Bank Holiday without prior written approval from the local planning authority.

To protect the amenity of the occupiers of the nearby residential properties. |
14. | For the duration of the construction period all traffic associated with the construction of the development will comply with the Construction Traffic Management Plan and use only the 'Construction Traffic Access Route' and no other local roads unless approved in writing with the Local Planning Authority in consultation with the Highway Authority.
Reason: In the interests of maintaining highway efficiency and safety.

15. | No works shall commence on site until the details of wheel cleaning facilities for construction vehicles have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority.
Reason: To prevent extraneous material being deposited on the highway.

16. | For the duration of the construction period all traffic associated with the construction of the development permitted will use the approved wheel cleaning facilities provided referred to in Condition 15 above.

17. | All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever, is the sooner, and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.

18. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |
