1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development shall be carried out in accordance with the information submitted on the application forms, the revised drawings 758/3 and 758/4 received by the Local Planning Authority on 18th April 2013 and the floor plans and section drawing received by the Local Planning Authority on 15th February 2013.

For the avoidance of doubt. |
3. | Prior to the first occupation of the dwelling hereby permitted the vehicular access shall be laid out in the position shown on the approved plan and constructed in accordance with Norfolk County Council residential access construction specification for the first five metres into the site as measured back from the near edge of the adjacent carriageway. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway.
The reason for the condition is :-
To ensure satisfactory access into the site and avoid carriage of extraneous material or surface water from or onto the highway. |
4. | Prior to the first occupation of the dwelling hereby permitted any access gate(s) shall be hung to open inwards and set back a minimum distance of five metres from the near channel edge of the adjacent carriageway.
The reason for the condition is :-
To enable vehicles to safely draw off the highway before the gate(s) is opened. |
5. | Prior to the first occupation of the dwelling hereby permitted the proposed access, on-site car parking and turning area shall be laid out in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is :-
To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety. |
6. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting the order) no windows or other openings (except those shown on the approved drawings) shall be inserted into the walls or roof of the east elevation of the dwelling hereby approved.
The reason for the condition is:-
In the interests of the residential amenities of the occupiers of the adjacent property. |
7. | If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) should be carried out until the developer has submitted and agreed a remediation strategy with the Local Planning Authority detailing how this unsuspected contamination will be dealt with. The remediation strategy shall be implemented as agreed.
The reason for the condition is :-
To protect and prevent the pollution of controlled waters (particularly groundwater associated with the Secondary and Principal Aquifers underlying the site from potential pollutants associated with current and previous land uses in line with National Planning Policy Framework (NPPF; paragraphs 109 and 121), EU Water Framework Directive, Anglian River Basin Management Plan and Environment Agency Groundwater protection: Principles and practice (GP3) 2012 position statements. |
8. | No development shall take place until an archaeological written scheme of investigation has been submitted to and approved by the Local Planning Authority in writing. The scheme shall include an assessment of significance and research questions; and 1) The programme and methodology of site investigation and recording, 2) The programme for post investigation assessment, 3) Provision to be made for analysis of the site investigation and recording, 4) Provision to be made for publication and dissemination of the analysis and records of the site investigation, 5) Provision to be made for archive deposition of the analysis and records of the site investigation and 6) Nomination of a competent person or persons/organisation to undertake the works set out within the written scheme of investigation.

In order to enable investigation and recording of this site of archaeological interest to take place during the period of building works. |
9. | No development shall take place other than in accordance with the written scheme of investigation approved under condition 8 of this permission.

10. | The dwelling hereby approved shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the archaeological written scheme of investigation approved under condition 8 of this permission and the provision to be made for analysis, publication and dissemination of results and archive deposition has been secured.
The reason for the condition is :-
In order to enable investigation and recording of this site of archaeological interest to take place during the period of building works. |
11. | Demolition and construction work shall not take place outside the following hours:-
08:00 to 18:00 Monday to Friday
09:00 to 13:00 Saturday
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)

In the interests of the residential amenities of the occupiers of nearby dwellings. |
12. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria of Policies HOU15, HOU16 and NNV7 of the Great Yarmouth Borough-Wide Local Plan and the aims of the National Planning Policy Framework regarding the development of brownfield sites. |
13. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |
