| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development hereby permitted shall be carried out in accordance with the application form and Design and Access Statement received by the Local Planning Authority on 14th February 2013 and in accordance with the amended plan (Drawing No. 796/1 Rev A) received by the Local Planning Authority on 8th April 2013.
The reason for the condition is :-
For the avoidance of doubt and to ensure the satisfactory development of the site in accordance with the approved plan. |
| 3. | No work shall commence until the exact type and colour of the facing bricks and roof tiles have been submitted to and approved by the Local Planning Authority.
The reason for the condition is :-
In the interests of the visual amenities of the area as precise details of these materials have not been submitted. |
| 4. | Details of the surfacing of the private drive, driveways, paths and areas of hardstanding shall be agreed in writing by the Local Planning Authority before any work commences on the site.
Reason for the condition is:-
To ensure the satisfactory appearance of the development. |
| 5. | Notwithstanding the submitted details on the approved plan, unless otherwise agreed in writing by the Local Planning Authority, the proposed private drive shall be maintained in perpetuity at a minimum width of 5.0 metres for the length of the access road and at a minimum width of 6.0 metres adjacent to the frontage of the dwellings hereby permitted. Furthermore, it shall be constructed perpendicular to the highway carriageway for a minimum length of 10 metres as measured from the near edge of the highway carriageway.

In the interest of highway safety and traffic movement. |
| 6. | Prior to the first occupation of the development hereby permitted, the proposed access and on-site car parking shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is :-
To ensure the permanent availability of the parking / manoeuvring area, in the interests of highway safety. |
| 7. | Prior to the commencement of the development hereby permitted and to the satisfaction of the Local Planning Authority, a site investigation shall be carried out to assess the extent (if any) to which the land and ground waters underlying the site are contaminated by virtue of previous uses of the site. The investigation shall include a desktop study detailing the previous uses and a risk assessment including a conceptual model of the likely effects of any contaminents. The applicant shall progress to a full intrusive site investigation if necessary and where contamination is found to exist, provide a validated Remediation Strategy to the satisfaction of the Local Planning Authority.

In the interests of public health and safety, and to protect the future occupants of the site from pollution arising from land contamination. |
| 8. | Construction work shall not take place outside the following hours:
08.00 to 18:00 Monday to Friday
09:00 to 13:00 Saturday
No work shall take place on Sundays and Bank Holidays.
Construction work outside these hours is permissible provided the work is not audible at the boundary of the nearest noise sensitive dwelling.
If piling is to be used, the quietest appropriate method shall be employed and shall not take place outside the following hours:
09:00 to 17:00 Monday to Friday
09:00 to 13:00 Saturday
No piling shall take place on Sundays or Bank Holidays.
The reason for the condition is :-
To ensure the amenities of adjacent residents are not disturbed to any significant or detrimental degree. |
| 9. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that order) no enlargement of or alteration to the bungalows hereby permitted shall be undertaken and no building, structure or means of enclosure within the curtilage of the bungalows shall be erected unless planning permission has first been granted by the Local Planning Authority.
The reason for the condition is:-
To enable the Local Planning Authority to retain control over any future development of the site in the interests of the amenities of adjoining residential properties. |
| 10. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that order) no windows, other than those shown on the approved plan, shall be inserted in the walls and roofs of the bungalows hereby permitted and no dormer windows shall be added to the bungalows unless planning permission has first been granted by the Local Planning Authority.
The reason for the condition is :-
To enable the Local Planning Authority to retain control over any future development of the site in the interests of the amenities of adjoining residential properties. |
| 11. | REASON FOR APPROVAL OF THE APPLICATION :-
The Borough Council considers that, subject to the above conditions, the proposal is compliant with Policies HOU7/HOU8, HOU15 and HOU17 of the adopted Great Yarmouth Borough-Wide Local Plan. |
| 12. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF. |
