1.The site of the proposed development lies within an area designated as Employment Land in the Great Yarmouth Borough-Wide Local Plan (adopted 23rd February 2001). The site is also outside the 'Village Development Limit' (Policy HOU7) for Martham as shown on the proposals Map of the Local Plan. Therefore the proposed development is contrary to the Local Plan and forms a departure from it as the proposed dwellings are not connected with agriculture as is usual for dwellings outside defined residential development limits. Furthermore insufficient information has been submitted to demonstrate to the satisfaction of the Local Planning Authority that the dwellings could not have been accommodated within the existing village development limit.
2.The National Planning Policy Framework (NPPF) states that decision-takers may also give weight to relevant policies in emerging plans according to: a) The stage of preparation of the emerging plan (the more advanced the preparation, the greater the weight that may be given); b) The extent to which there are unresolved objections to relevant policies (the less significant the unresolved objections, the greater the weight that may be given); and c) The degree of consistency with the NPPF. Policy CS6 of the emerging Core Strategy (Regulation 18) has received no negative comments and therefore the Policy has been given strong weighting. The proposal is considered to be contrary to Policy CS6 which, in its aim of supporting the local economy, seeks to safeguard existing local employment sites. The site in this application lies within an area identified as a "Safeguarded existing local employment area" in the Core Strategy.
3.It is the policy of the Local Planning Authority, as set out in the Local Plan for the area, to require all housing development proposals to be assessed according to the quality of the environment to be created, including the design and position of buildings and appropriate car parking and servicing provision. In this case, the proposal contains inappropriate design elements particularly the relationship of the proposed dwelling at the southern end of the scheme with the adjacent boundary and the car parking provision does not accord with the Borough Council's standards. In addition, the positioning of the building in close proximity with the western boundary of the application site does not afford convenient pedestrian access to outdoor amenity space and garaging. The proposal is therefore considered to be contrary to Policies BNV16, HOU15 and TCM17 of the adopted Great Yarmouth Borough-Wide Plan.
4.STATEMENT OF POSITIVE ENGAGEMENT : In accordance with the NPPF, in determining this application for planning permission the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable development and has been refused for the reasons set out above.
