| 1. | The proposed parking arrangements would require the removal of historic fabric and bring a striking visual change to the boundary of the Grade II* listed building by forming a large opening which would change the boundary line and alter the way the church complex is accessed. The boundary wall is a strong feature on the church's southern side, separating and helping to distinguish it from the residential development adjacent as a building of status and of a particular function which contributes to the character and significance of the church as a Grade II* listed building. |
| 2. | The National Planning Policy Framework (NPPF) identifies the need for the protection and enhancement of the historic environment as an important element of sustainable development and establishes a presumption in favour of sustainable development within planning. The NPPF also states that the significance of listed buildings and conservation areas can be harmed or lost by alteration to them or development within their setting and that the conservation of heritage assets such as St Marys Church and the surrounding Conservation Area is a core principal of the planning systems. Furthermore the NPPF states that proposals that preserve those elements of the setting that make a positive contribution to, or better reveal the significance of the heritage assets should be treated favourably, however in these circumstances the submitted scheme is not considered acceptable and does not accord with the NPPF or Great Yarmouth Local Plan Policy, particularly BNV7 and BNV10. |
| 3. | Therefore for the reasons given above the proposed demolition of the boundary wall and the creation of the new car parking area and associated works will result in harm to the setting of the church, the listed boundary wall itself and to the Conservation Area contrary to both local and national planning policy an there has been no clear and convincing justification submitted which would alter the opinion of the Local Planning Authority and English Heritage to the significance of these heritage assets. |
| 4. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS):
In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
