1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development hereby permitted shall be carried out entirely in accordance with the details shown on the application forms, supporting statement, site layout plan prepared by Barry Cutts and Drg no.1222/HWY/001A prepared by ASD Engineering all received by the Local Planning Authority on 23rd November 2012. The reason for the condition is :- For the avoidance of doubt.
3.Notwithstanding the details relating to foul sewage disposal on the application forms and plans, the development hereby permitted shall not be commenced until such time as a scheme to dispose of foul drainage has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented as approved concurrently with the site being brought into use and thereafter maintained in accordance with the approved details. The reason for the condition is:- The National Planning Policy Framework paragraph 109 states that the planning system should contribute to and enhance the natural and local environment5 by preventing both new and existing development from contributing to or being put at unnacceptable levels of water pollution. The approach to groundwater protection is set out in Groundwater Protection: Principles and Practice November 2012. In implementing the position statements in this guidance The Local Planning Authority in consultation with the Environment Agency will oppose development proposals that may pollute groundwater especially where the risks of pollution is high and the groundwater asset is of high value. The applicant has not provided sufficient information to enable a full assessment of the risk to controlled waters to be made.
4.The use of the site for holiday purposes and occupation of the units of holiday accommodation as shown on the approved drawing shall only take place between 1st March to 31st October in any one year and the site shall not be used for any other purpose without the prior consent of the Local Planning Authority. The reason for the condition is:- To ensure the seasonal safari style tents are not used as permanent units of residential accommodation contrary to Policy TR4 of the adopted Great Yarmouth Borough-Wide Local Plan.
5.Before the development is commenced a scheme of planting and landscaping shall be submitted for the approval of the Local Planning Authority and the planting of trees and shrubs shall be carried out in accordance with the scheme as approved within six months of the approval. Any trees and shrubs so planted which dies within 5 years shall be replaced within one year by the applicants or their sucessors in title. The reason for the condition is:- To enhance the visual amenities of the locality
6.Prior to the commencement of the use hereby permitted the vehicular access (indicated for improvement on drawing No 1222/HWY/001/A.) shall be upgraded/ widened to a minimum width of 5.5 metres and provided with kerb radii of 10.00m in accordance with the Norfolk County Council residential / industrial access construction specification for the first 10.00 metres as measured back from the near channel edge of the adjacent carriageway. Arrangement shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway carriageway. The reason for the condition is:- In the interest of highway safety and traffic movement.
7.Notwithstanding the provision of Class A of Schedule 2, Part 2 of the Town and Country Planning (General Permitted Development) Order 1995, (or any Order revoking, amending or re-enacting that Order) no gates, bollard, chain or other means of obstruction shall be erected across the approved access unless details have first been submitted to and approved in writing by the Local Planning Authority. The reason for the condition is:- In the interests of highway safety.
8.Prior to the commencement of the use hereby permitted) a visibility splay measuring 2.4 X 90 metres shall be provided to each side of the access where it meets the highway and such splays shall thereafter be maintained free from any obstruction exceeding 0.6 metres above the level of the adjacent highway carriageway. The reason for the condition is:- In the interests of highway safety.
9.Notwithstanding the details indicated on the submitted drawings no works shall commence on site until a detailed scheme for the off-site highway improvement works as indicated on Drawing number 1222/HWY/001/A have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is:- To ensure that the highway improvement works are designed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor.
10.Prior to the first occupation of the development hereby permitted (or Prior to the commencement of the use hereby permitted) the off-site highway improvement works referred to in part of condition 9 shall be completed to the written satisfaction of the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is:- To ensure that the highway network is adequate to cater for the development proposed.
11.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the requirements of policies TR2, TR3 and NNV5 of the Great Yarmouth Borough-Wide Local Plan in providing an alternative form of holiday provision which is also considered to comply with the National Planning Policy Framework.
12.The layout of the site shall accord entirely with the details shown on submitted drawing and no more than 11 pitches with associated unit of tented holiday accommodation shall be located on the site. The reason for the condition is:- For the avoidance of doubt.
13.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
14.NOTES - Please read the following notes carefully:- It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority This development involves work to the public highway that can only be undertaken within the scope of a legal Agreement between the applicant and the County Council. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary Agreements under the Highways Act 1980 are also obtained. Advice on this matter can be obtained from the County Council's Highways Development Control Group based at County Hall in Norwich. Please contact Stuart Frenchon 01603 638070. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer. If required, street furniture will need to be repositioned at the applicants own expense. This proposal involves excavations adjacent to the public highway. It is an OFFENCE to carry out any works that may affect the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicants' responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council.
