| 1. | Policies BNV7, BNV9 and BNV10 of the adopted Great Yarmouth Borough-Wide Local Plan seek to safeguard the character and setting of listed buildings and to retain and enhance the character and appearance of conservation areas.
The construction of a new dwelling on this site would not only harm the significance of The Vicarage, a Grade II Listed Building, but the overcrowded appearance that this would create within the historic streetscape would neither preserve nor enhance the character and appearance of this part of the Martham Conservation Area. The resulting harm will not be offset by any wider public benefit. |
| 2. | Policy HOU17 of the adopted Great Yarmouth Borough-Wide Local Plan states that, in assessing proposals for development the Borough Council will have regard to the density of the surrounding area. Sub-division of plots will be resisted where it would be likely to lead to development out of character and scale with the surroundings.
The proposal to subdivide the existing grounds of The Vicarage and the construction of a new dwelling in this location will result in a very cramped relationship on the north side of The Vicarage between it and the new dwelling, which will adversely impact on the setting of The Vicarage and result in harm to its significance. This 'crowding' will also adversely impact on the architectural and historic significance of the listed building and the character and appearance of the Martham Conservation Area. |
| 3. | Policy TCM13 of the adopted Great Yarmouth Borough-Wide Local Plan states that development will not be permitted where it would endanger highway safety or the satisfactory functioning of the local highway network. Inadequate visibility splays have been provided at the junction of the access with the County Highway and this could cause danger and inconvenience to users of the adjoining public highway. |
| 4. | The proposal is therefore considered to be contrary to Policies BNV7, BNV9, BNV10, TCM13, HOU15 and HOU17 of the adopted Great Yarmouth Borough-Wide Local Plan.
It is further considered that the proposal would result in harm to the historic environment and that there would be no public benefit arising to outweigh that harm and therefore the proposal is also contrary to paragraph 134 of the National Planning Policy Framework.

| 5. | STATEMENT OF POSITIVE ENGAGEMENT : In accordance with the NPPF, in determining this application for planning permission the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable development and has been refused for the reasons set out above. |
