No.Condition Text
1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.No work shall commence until the exact type and colour of the materials have been submitted to and approved by the Local Planning Authority. The reason for the condition is :- In the interests of the visual amenities of the area as precise details of the materials have not been submitted.
3.The following hours of construction should be adhered to:- Monday to Friday 07.30 to 18.00 hours Saturday 08.00 to 13.00 hours No works are to take place on Sundays and Bank Holidays, and all other hours no work producing audible noise at the nearest noise sensitive property. The reason for the condition is :- To ensure the amenities of adjacent residents are maintained.
4.The development shall be constructed with a minimum finished ground floor level of 2.41mAOD. The reason for the condition is :- To ensure that the development remains dry in the event of flooding for the adequate protection of the occupants.
5.The development shall be constructed with a refuge area made available on the second floor (marked communal area on the plans hereby approved) for occupants of the properties, as per drawing reference 0843/1B (dated July 2008) and shall be maintained for that specific purpose thereafter. The reason for the condition is :- To ensure that the development provides adequate refuge for occupants in the event of extreme flooding.
6.Prior to the commencement of development, a scheme for the provision and implementation of flood proofing measures shall be submitted to and agreed in writing, with the local planning authority. The scheme shall be carried out in its entirety before the development is first occupied and constructed and completed in accordance with the approved plans and in line with the ODPM publication 'Preparing For Floods'. The reason for the condition is :- To minimise the damage to the development in the event of flooding and enable a faster recovery once floodwaters have subsided.
7.Prior to the commencement of development, a scheme for the provision and implementation of surface water drainage shall be submitted to and agreed in writing with the local planning authority. The scheme shall be constructed and completed before occupancy of any part of the proposed development. The reason for the condition is :- To ensure a satisfactory method of surface water drainage.
8.No part of the proposed structure shall overhang or encroach upon highway land and no door, window or gate shall open outwards over the public footway. The reason for the condition is :- To prevent obstruction of the public highway/footway in the interests of highway/footway safety.
9.Prior to the commencement of demolition a full scheme detailing the proposed protection and repair works for the adjoining wall at 10 Beaconsfield Road, shall be submitted to and agreed in writing with the local planning authority and all works carried out in accordance with such a scheme. The reason for the condition is :- In order to protect the structural integrity of the adjoining proprerty and to ensure the amenities of the occupants of the dwelling.
10.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the provisions of the Great Yarmouth Borough Wide Local Plan and, in particular, policies HOU7 and HOU15.
11.The applicant's attention is drawn to the comments of the Borough Council's Environmental Health Department:- Every effort should be made to reduce the impact of dust generation to local residential properties and commercial businesses, in the proximity of the development. Where possible a supply of water, protected against frost, should be available to address the problem, alternatively, erection of hoardings to prevent dust travel must be considered.
