| 1. | Policy BNV10 of the adopted Great Yarmouth Borough-Wide Local Plan states that new development in or adjacent to a conservation area will be required to be sympathetic to the character and appearance of the area in terms of scale, height, form, massing, materials, siting and design.
Whilst the proposed garage is, in itself, acceptable in terms of appearance and design within the conservation area, the siting of the proposed entrance to the double garage will necessitate an access which will cross part of the Village Green, and which relies on land outside of the control of the applicant. It is considered that, in terms of the affects on the appearance of The Green, the formation of an access across any part of The Green with the associated surfacing works, will be deterimental to the character of the surrounding conservation area. |
| 2. | Policy TCM13 of the adopted Great Yarmouth Borough-Wide Local Plan states that development will not be permitted where it would endanger highway safety or the satisfactory functioning of the local highway network.
The access to the proposed garage would join the highway at the junction of two roads, albeit minor roads, but it is considered that this would cause a hazard and is therefore not acceptable in terms of highway safety. Safety implications for the users of the highway in this instance relate not only to possible conflict but also to potential obstruction of visibility splays as it is likely vehicles would not always park in the garage. |
| 3. | The point at which the proposed access meets the highway coincides with an area of dropped kerb installed by Norfolk County Council in order to meet requirements to provide access to The Green in compliance with the Disability Discrimination Act. The installation of a vehicular access at this point may have the potential to give rise to a situation where this access to The Green for disabled persons may be blocked by parked vehicles. |
| 4. | Therefore, for the reasons given above, the development is considered to be contrary to Policies BNV10 and TCM13 of the adopted Great Yarmouth Borough-Wide Local Plan. |
