23.The Environment Agency have provided the following additional information in respect of condition 18 of this permission to prevent the increased risk of flooding, to improve and protect water quality, and ensure future maintenance of the SuDS features. We provide the following explanation and advice in relation to the proposed surface water drainage strategy: Infiltration rate There have not been any infiltration tests carried out on the site itself but it has been confirmed verbally with the FRA consultant that the highway drainage to the west of the site utilises soakaways. The suggested rate of 4x10-5 has been ascertained following testing on a site to the south east, adjacent to the NCL site. This rate has been adopted for this development as the FRA suggests the geology of the area is consistent. However, it has been acknowledged in paragraph 4.9 of the FRA that site-specific infiltration testing will be required on the site itself. This will be fundamental to the detailed design of the proposed surface water drainage strategy as varying rates would have the potential to require alterations to the design. If the infiltration rate were to be lower than currently worked to, more storage would be required in the infiltration blanket and soakaways to manage larger events. Based on the current design and layout it appears there is the ability to either increase the depth (or even extent) of the infiltration features. It is for this reason that we have not insisted on site specific infiltration tests at this stage of the surface water drainage strategy development for this site. Maintenance of surface water drainage system The future maintenance of all elements of the surface water drainage strategy will be essential to the future efficiency of the system in a range of rainfall events. Chapter The12.8 of the SuDS manual (C697) provides guidance on the operation and maintenance requirements of pervious pavements. This includes regular and occasional maintenance as well as remedial actions and monitoring. The construction requirements listed in Section 12.9 of the SuDS Manual will also be essential to follow in order to ensure the pavement structures operate as designed from the outset. Construction activities have the potential to severely affect infiltration rates if care is not taken to protect against compaction or blockage from fines. Exceedence flows The SuDS manual (C697) Section 12.3.1 states that designs using total infiltration (such as this proposal) should include emergency overflow provisions such as outlets onto adjacent grassed areas. The site topographic survey suggests a general fall across the site to the south west. Any exceedence flows in rainfall events larger than designed for, or if there is clogging of the pervious pavements will therefore result in flows towards the landscaped area. At present however there are no details of whether there are emergency overflow provisions. Paul Robinson Partnership drawing 6833 P02 Rev G shows a bund around the landscaped area which could act to contain any such flows. The SuDS manual also suggests in Section 12.7 that, wherever possible, landscaped areas around pervious pavements should have a top soil level at least 50mm below the top of the kerb adjacent to the pervious pavement. This could also assist in managing the exceedence flows discussed above. Where landscaped areas drain onto a pervious pavement, the landscaped surfaces should be stabilised so that the mobilisation of silt and other fine debris is minimised. We recommend that further consideration is therefore given to the management of exceedence flows during the detailed design stage. Pollution Prevention Any above ground oil storage tank(s) should be sited on an impervious base and surrounded by a suitable liquid tight bunded compound. No drainage outlet should be provided. The bunded area should be capable of containing 110% of the volume of the largest tank and all fill pipes, draw pipes and sight gauges should be enclosed within its curtilage. The vent pipe should be directed downwards into the bund. Our Pollution Prevention Guidance notes are available to view on our website at: http://www.environment-agency.gov.uk/business/topics/pollution/39083.aspx. Hazardous Waste The planning application form states at Section 23 that hazardous waste is involved in the proposal. No further information is provided. If the occupiers of the site will produce, transport, or receive hazardous waste, they will be regulated by the Hazardous Waste Regulations. It should be noted that implementation of the revised Waste Framework Directive has brought some changes to the Hazardous Waste Regulations. These changes have been brought in by the Waste (England and Wales) Regulations 2011 and the Waste (Miscellaneous Provisions) (Wales) 2011 Regulations. The applicant should note that any producers of hazardous waste must be registered unless the total quantity produced is less than 500Kg each year. This registration must be renewed each year. A permit might also be required under the Environmental Permitting Regulations 2010. If the occupier will be involved in the movement of hazardous waste, a consignment note will be required. Further information on the changes to the Hazardous Waste Regulations, registration as hazardous waste producers and consignment notes is available from our website at: http://www.environment-agency.gov.uk/business/topics/waste/32180.aspx.
24.This development involves a Travel Plan to be implemented within the scope of a legal Agreement between the applicant and the County Council. Please note that it is the applicants' responsibility to ensure that, in addition to planning permission, any necessary Agreements under the Town and Country Planning Act 1990 or Highways Act 1980 are also obtained. Advice on this matter can be obtained from the County Council's Highways Development Control Group based at County Hall in Norwich. Please contact (insert appropriate contact details). Commuted Sum for Travel Plans The Highways Authority levies a charge to cover the on-going costs of reviewing and monitoring a Travel Plan annually. The Highways Authority also requires a Bond to ensure that the Travel plan targets are met. Both the Bond and the monitoring charge are secured by a Section 106 Legal Agreement. This is in addition to the sum payable for Planning Obligations covering infrastructure, services and amenities requirements. An online survey tool is available to assist with annual monitoring. For further information on the survey tool, Please contact David Higgins on 01603 222789 or David.higgins@norfolk.gov.uk The applicant's attention is draw to the attached comments of the Norfolk Constabulary with regard to crime prvention measures on the proposed development.
