1.The site of the proposal lies to the west of a large residential development, separated only by the Lowestoft Road, on the eastern edge of the village of Hopton. The access to the site is from the Lowestoft Road adjacent to the residential development. The land immediately to the south of the site has a current planning application for a 60 bedroom residential care facility and 10 No. 2 bedroom individual living units. The increased level of activity proposed must take into consideration the close proximity of the residential dwellings. Policy SHP12 (Petrol Filling Stations and Service Areas) of the adopted Borough-Wide Local Plan will apply. Policy SHP12 (Criterion B) states that petrol filling stations and service areas may be permitted only where there would be no significant adverse impact arising from noise or general disturbance. Condition Nos. 11 and 13 of the planning permission No. 06/07/0268/F were imposed in order to protect the residential amenity of the nearby residential properties and therefore the removal of these conditions will be contrary to Policy SHP12 Criterion B.
2.Policy TCM3 (New Motorist and/or Lorry Service Facilities) of the adopted Borough-Wide Local Plan (Criterion A) states that new motorist and/or lorry facilities will only be permitted where a need for the facility can be demonstrated. No evidence for the need to extend the operating hours of the facilities at the site, either for passing motorists or for the local community, has been demonstrated. The proposal is therefore contrary to policy TCM3 of the adopted Borough-Wide Local Plan.
3.For the reasons given above the proposed development is contrary to Policy SHP12 (Criterion B) and Policy TCM3 of the adopted Great Yarmouth Borough-Wide Local Plan in that it will have a significant adverse impact on the residential amenities of the nearby residential properties due to noise and general disturbance for an extended period, without proven need for the additional facilities proposed.
