1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The use hereby approved shall not commence until a plan showing the on-site parking arrangements has been submitted to and approved by the Local Planning Authority in conjunction with the Highways Authority. The parking area/s shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan prior to the commencement of the use and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the on-site parking and turning facilities for the development.
3.The use hereby permitted shall only be operated between the hours of 09.00hrs to 22.00hrs on any day. The reason for the condition is :- To retain control over the hours of use of the premises.
4.Prior to the occupation of this development, a flood response plan shall be submitted to, and agreed in writing with, the Local Planning Authority, in consultation with the Environment Agency. Once agreed this shall form part of the Health and Safety File for the building, under the Construction, Design and Management (CDM) Regulations. The reason for the condition is :- To ensure that the owners and visitors of the site are aware that the land is at risk of flooding and that the flood plan information is passed onto any subsequent owners of the building.
5.Flood warning notices shall be erected in numbers, positions and with wording to be agreed with the Local Planning Authority. The notices shall be kept legible and clear of obstruction. The reason for the condition is :- To ensure that occupants and users of the development are aware that the site is at risk of flooding.
6.As per paragraph 6.2 of the FRA any new works being contemplated at the site should incorporate measures set out in "Preparing for Floods" and will be placed above the design flood event level of 1.939mAOD. The reason for the condition is :- To minimise the damage to the development in the event of flooding and enable a faster recovery once floodwaters have subsided as is set out in paragraph 5.41 of the PPS25 Practice Guide.
7.The development shall have a minimum finished floor level of 0.97mAOD as per paragraph 6.1 of the FRA. The reason for the condition is :- A finished floor level of 0.97mAOD, although below the design flood event at the end of the lifetime of the development, is equal to the floor level currently at the site and would not represent a decrease in the finished floor level at the site.
8.REASON FOR APPROVAL OF THE APPLICATION :- The proposal is in accordance with Policy REC1 of the Great Yarmouth Borough-Wide Local Plan.
