1. | The development hereby permitted shall not be carried out except in accordance with the details shown on the submitted plans, Drawing Numbers:P1-100 REV C,P1-200 REV C,P1-300 REV C,P1-400 REV C,P1-500 REV C,P1-600 REV C,P1-700 REV C,P2-100 REV B,P2-101 REV B,P3-100 REV c,P2-103 REV C.JNY6157-74.

For the avoidance of doubt.

2. | Application for approval of reserved matters must be made not later than the expiration of five years beginning with the date of this permission and the development must be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved.
The reason for this condition:-
The time limit condition is imposed in order to comply with the requirements of Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

3. | No development whatsoever shall take place until full details of the following matters have been submitted to and approved in writing by the Local Planning Authority and the development shall be carried out strictly in accordance with such approved details.
3.1 Details of the layout, floor plans, design and external appearance of the hotel (the submission of reserved matters referred in condition 2 above)
3.2 Details of all external materials (including sample panels) and any security shutters (the submission of reserved matters referred in condition 2 above)
3.3 Details of all floorscape and paving materials (including samples) and other hard and soft landscaping of the site, including boundary treatments of the open car park (see condition 5 below) (the submission of reserved matters referred in condition 2 above)
3.4 Details of all roofing materials
3.5 Details of all lighting, including computer controlled lighting of exterior, lux diagrams and hours of illumination.
3.6 Details of all enclosures of plant and machinery and all details of any external extraction units.
3.7 Details of public art provision, locations and schedule of implementation.
3.8 Details of the phasing of construction and completion of the development (see condition 4 below)
3.9 Details of the provision & implementation of surface water drainage
3.10 Details of a Construction Method Statement (see condition 7 below)
3.11 Details of a Construction Traffic Management Plan and Construction Access route (see condition 10 below);
3.12 Details of a scheme for the storage of refuse and recycling (see condition 11 below)
The reasons for the condition are:-
Such details have not been submitted as part of this application and in the interests of the visual and other amenities of the area, of highway safety, and the avoidance of pollution.

4. | No development shall take place until a schedule of the phasing of construction, completion and occupation has been submitted to and approved by the Local Planning Authority.
The implementation of the development shall take place in accordance with that approved schedule, and no alteration to the agreed schedule shall take place without the approval in writing of the LPA.

To ensure the development is carried out in an orderly fashion and to the best interests of maintaining an attractive and vibrant seafront, and to reduce the impact of construction on nearby residential and commercial premises

5. | No development shall take place until full details of both hard and soft landscaping works have been submitted to and approved in writing by the Local Planning Authority and these works shall be carried out as approved. These details shall include proposed finished levels or contours; means of enclosure; car parking layouts; other vehicle and pedestrian access and circulation areas; hard surfacing materials; minor artefacts and structures (e.g. furniture, play equipment, refuse or other storage units, signs, lighting etc.); proposed and existing functional services above and below ground (e.g. drainage, power, communications cables, pipelines etc, indicating lines, manholes, supports etc); retained historic landscape features and proposals for restoration, where relevant. Soft landscape works shall include planting plans; written specifications (including cultivation and other operations associated with plant and grass establishment); schedules of plants, noting species, plant sizes and proposed numbers/densities where appropriate; and implementation programme.

To ensure that the proposed development does not prejudice the appearance of the locality and to preserve and enhance nature conservation interests.

6. | The developer shall afford access at all reasonable times to any archaeologist nominated by the local planning authority, and shall allow him to observe the excavations and record items of interest and finds.

In accordance with Paragraph 54 of Appendix A of Planning Circular 11/95: The Use of Conditions in Planning Permissions relating to watching briefs during construction. |
7. | No development shall take place, including any works of demolition, until a Construction Method Statement has been submitted to, and approved in writing by, the local planning authority.
The approved Statement shall be adhered to throughout the construction period.
The Statement shall provide details of:
7.1 the parking of vehicles of site operatives and visitors
7.2 the loading and unloading of plant and materials
7.3 the locations of storage of plant and materials used in constructing the development
7.4 the erection and maintenance of security hoarding including decorative displays and facilities for public viewing, where appropriate
7.5 the siting and operation of wheel washing facilities
7.6 measures to control the emission of dust and dirt during construction
7.7 a scheme for recycling/disposing of waste resulting from demolition and construction works
7.8 delivery methods and times to the different parts of the development
7.9 methods and timing of piling to minimise disturbance to nearby properties

8. | The development hereby permitted shall not be commenced until an Interim Travel Plan has been approved in writing by the Local Planning Authority in consultation with the Highway Authority, and such a Travel Plan shall accord with Norfolk County Council document Guidance Notes for the Submission of Travel Plans¿ or be produced using the Workplace Travel Plan Generator Tool, www.worktravelplan.net

To ensure that the development offers a wide range of travel choices to reduce the impact of travel and transport on the environment.

9. | No part of the development hereby permitted shall be occupied prior to implementation of the Interim Travel Plan referred to in condition 8 above. During the first year of occupation a Full Travel Plan based on the Interim Travel Plan referred to condition 8 above shall be submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. The Approved Full Travel Plan shall be implemented in accordance with the timetable and targets contained therein and shall continue to be implemented as long as any part of the development is occupied subject to approved modifications agreed in writing by the Local Planning Authority in consultation with the Highway Authority as part of the annual review.

10. | The development hereby permitted shall not be commenced until a Construction Traffic Management Plan and Access Route has been approved in writing by the Local Planning Authority in consultation with Norfolk County Council the Highway Authority together with proposals to control and manage construction traffic using the 'Construction Traffic Access Route' and to ensure no other local roads are used by construction traffic.

In the interests of maintaining highway efficiency and safety

11. | No development shall take place until a scheme for the storage of refuse and recycling has been submitted to and approved in writing by the Local Planning Authority. The works shall be carried out in full as approved prior to occupation and the refuse and recycling storage facilities shall thereafter be retained for use at all times.
The reason for the condition is:-
To ensure the provision of satisfactory facilities for the storage of refuse.

12. | Whilst it is acknowledged that investigations into the possibility of contaminated land on the site have been carried out in consultation with the Environment Agency, together with an agreed remediation strategy, if any unidentified contamination is discovered, no development approved by this permission shall be continued until the developer has submitted an amendment to the remediation strategy, indicating methods of dealing with the contamination, and such methods being approved in writing by the Local Planning Authority in conjunction with the Environment Agency.
The reason for the condition is:-
Previous historical activities associated with this site may have potentially caused, or have the potential to cause, contamination of controlled waters and to ensure that the proposed site investigations and remediation will not cause pollution of controlled waters, and in accordance with policies of the Great Yarmouth Borough Wide Local Plan 2001.

13. | The access shall be constructed with adequate drainage measures to prevent surface water run-off onto the adjacent public highway, in accordance with a detailed scheme submitted to and approved in writing by the Local Planning Authority, in consultation with the Highway Authority.

14. | For the duration of the construction period all traffic associated with the construction of the development will comply with the Construction Traffic Management Plan and use only the Construction Traffic Access Route and no other local roads unless approved in writing with the Local Planning Authority in consultation with the Highway Authority

15. | The scheme for surface water disposal as detailed in the application hereby permitted shall be constructed and completed before occupation of any part of the proposed development.
The reason for the condition is:-
To ensure that the proposed surface water drainage is designed and constructed to accommodate 1 in 100 year return period rainfall at the end of the life time of the developmentand to ensure that the proposed development results in no increase in the off-site flood risk.

16. | Prior to the first occupation of the development hereby permitted, visibilty splays measuring 2.4 metres x 90 metres shall be provided in full accordance with the details indicated on the approved plan Drawing No JNY6157-74. The splay shall thereafter be maintained free from any obstruction exceeding 0.225 metres above the level of the adjacent highway carriageway.

17. | No works shall commence on site until the the details of Wheel Cleaning facilities for construction vehicles have been submitted to and approved in writing by the local planning authority in consulation with the Highway Authority and for the duration of the construction period all traffic associated with the construction of the development shall use the Approved Wheel Cleaning facilities provided.
The reason for the condition is:-
To prevent extraneous materials being deposited on the highway. |
18. | Prior to the first occupation of any part of the development hereby permitted the proposed access / on-site car and cycle parking / servicing / loading, unloading / turning / waiting area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plans and retained thereafter for that specific use.
As detailed on the approved plans, parking and servicing areas provision for the individual land uses within any plot shall not exceed a total of 832 car parking spaces including disabled parking and 40 Powered Two Wheeler spaces on the ground floor unless otherwise agreed in writing by the Local Planning Authority. Cycle Parking shall be provided in the form of 108 secure and covered Sheffield stands and will be subject to review as part of the Travel Plan. In addition 100 lockers and 5 unisex showers will be provided for visitors and staff which will also be subject to monitoring by the Travel Plan.

To ensure the permanent availability of the parking / manoeuvring area, in the interests of highway safety. |
19. | The enclosures to plant and machinery shall be completed to the satisfaction of the Local Planning Authority prior to the first occupation of the hotel, unless otherwise agreed in writing with Local Planning Authority.
The reason for the condition is:-
To ensure the satisfactory appearance of the development.

20. | The landscaping of the scheme shall be completed in accordance with the agreed schedule of implementation and maintenance (including replanting where necessary) and shall be maintained for the first five years from the completion of the development, unless otherwise agreed in writing by the Local Planning Authority. Any plant that dies within this timescale shall be replaced in the next appropriate planting season.

21. | The agreed public art scheme shall be provided in accordance with the agreed details and implementation schedule and shall be maintained in the approved form unless otherwise agreed in writing by the local planning authority.

22. | No surface water shall be discharge to the foul sewer.
The reason for the condition is:-
To avoid overloading the sewerage system and avoid problems of pollution

23. | No piling shall take place without the prior approval of the Local Planning Authority as to the method to be used, as set out in the submitted Construction Method Statement (as set out in Condition 7)
If such work is agreed, no piling shall take place outside the following hours:-
08:30 to 17:00 Monday to Friday
09:00 to 13:00 Saturday
The reason for the condition is:-
In the interests of the residential amenities of the occupiers of nearby dwellings, and the occupiers and users of nearby business premises.

24. | Demolition or construction works shall not take place outside 08:00 hours to 18:00 hours Mondays to Fridays and 09:00 hours to 13:00 hours on Saturdays and at no time on Sundays or Bank Holidays, unless otherwise agreed in writing with the Local Planning Authority. Such construction works refer to those which generate noise that is audible at the boundary of the nearest noise sensitive property.

In the interests of the residential amenities of the occupiers of nearby dwellings , and the occupiers and users of nearby business premises, and visual appearance of the area.

25. | Other than is approved by this permission, no building, structure, plant or other apparatus shall be erected, placed or fixed to any part of the roof or the external faces of the building.

To safeguard the appearance of the premises and the locality in general

26. | The premises shall not be open for the reception of new on-residential customers or users not already in the premises, except for the Casino, hotel or car park, outside the following hours: -
07:00 to 00:30 Sunday to Thursday
07:00 to 01:30 Friday and Saturday and no new admissions after 00:30

In the interests of the residential amenities of the occupiers of nearby dwellings and visual appearance of the area.

27. | Notwithstanding the provisions of the Town & Country Planning (Advertisement) Regulations or the lighting scheme as approved by details submitted in accordance with Condition 3.5, no advertisements, lights or symbols shall be placed on the exterior of any part of the building, or within 1 m. of the exterior of any window without the written consent of the Local Planning Authority.

To give the Local Planning Authority control over the appearance of the premises and the locality in general, and in the interests of safe navigation.

28. | Notwithstanding the provisions of the Town & Country Planning (General Permitted Development) Orders, no alterations to the external appearance or materials of the development hereby permitted, shall take place without the express written consent of the Local Planning Authority.

29. | No audible sound equipment shall be used or placed on the exterior of any building or structure hereby permitted.

30. | Whilst The Edge development is open there shall be a public route from South Beach Parade to The Beach Promenade.

31. | Notwithstanding the provisions of the Town & Country Planning (Use Classes) Orders, no changes to the proposed detailed uses of the individual modules of the development, shall take place without the written consent of the Local Planning Authority.

To give the Local Planning Authority control over the variety of uses and facilities offered by the development

32. | The area of open ground level car park south of the multi-storey car park shall be used solely for the parking of cars, and associated car park infrastructure, unless otherwise agreed in writing by the Local Planning Authority.Details of such infrastructure shall be submitted to and approved in writing by the Local Planning Authority and notwithstanding the provisions of the Town & Country Planning (General Permitted Development) Orders or the Town & Country Planning (Advertisement) Regulations, no mobile or permanent structures of any sort (including advertisements, or mobile vending operations) other than cars shall be placed on this area, unless otherwise agreed in writing by the Local Planning Authority.

33. | Fire hydrants, numbers and location as required by the Fire Officer, in consultation with the Local Planning Authority served by mains water supply shall be provided prior to any of development first being brought into use and to the satisfaction of the local planning authority in consultation with Norfolk Fire Service. The developer will incur the full cost of the hydrants and its installation by the water company.

34. | REASON FOR APPROVAL OF THE APPLICATION :-
The Council considers that the proposal would be an employment generator of economic benefit to the town in a sustainable location and contribute to the regeneration of and improve the character of the area which is a major ambition for the Borough Council. The proposal, subject to the above conditions, is considered to be compatible with the Goverment aims of delivering Sustainable Development and employment in appropriate locations within PPS 1 and subsequent guidance within Planning Policy Statements and Guidance including those related to the historic environment,design, tourism,noise, traffic and flood risk and the Great Yarmouth Borough-Wide Local Plan - Adopted 2001.

When Vehicular Access Works are required
This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing.
It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicants' responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Development Control Group .
Public Utility apparatus may be affected by this proposal. Please contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
