| 1. | The site is within an area zoned as 'Prime Retail Frontage' in the Great Yarmouth Borough-Wide Local Plan. Policy SHP4, criterion (B) of the Local Plan states that within such areas change of use to take-aways will only be allowed if the proposal does not result in a concentration or predominance of non-retail uses which would detract from the vitality and viability of the frontage; criterion (C) of the Policy states that change of use will only be acceptable providing it does not undermine the retail function of the frontage.
There are a significant number of existing food outlets in the High Street and the site is next to a property which has an existing limited A5 (take-away) use. It is, therefore, felt that another such use would be contrary to criteria (B) and (C) of Policy SHP4 in that it would result in an over provision of such uses which would detract from the vitality, viability and retail function of the High Street.
The proposal, by virtue of the likely consequence of noise, general disturbance and smell that would be generated would have a significant adverse effect on the occupiers of nearby residential properties. Such adverse effects would be contrary to criterion (B) of Policy SHP15 of the Local Plan which seeks, in relation to the provision of hot food outlets, to safeguard the amenities of the area. |
