| 1. | The site of the proposal lies outside the "Village Development Limit" for Winterton as defined in the adopted Great Yarmouth Borough-Wide Local Plan, i.e. within which new residential development may be permitted. Consequently, in assessing the proposal for the removal of the condition to allow unrestricted occupancy of the premises, Policies HOU10 and HOU11 of the Local Plan apply. Policy HOU10 states that permission for new dwellings in the countryside will only be given if required in connection with agriculture, forestry, organised recreation or the expansion of existing institutions. Policy HOU11 states that, outside "Village Development Limits", proposals for the change of use of existing buildings to residential use will be permitted where: (A) the applicant can demonstrate that every reasonable attempt has been made to secure suitable commercial re-use; or (B) residential conversion is a subordinate part of a scheme for commercial re-use. The use of the former holiday unit as granny annexe to the main dwelling, i.e. Church Farm, was granted on the basis that it should not become an entirely separate unit of living accommodation. No justification has been put forward in respect of the need for the unrestricted use of the premises, and it is considered, therefore, that the removal of the condition would be contrary to the above mentioned policies. |
