| 1. | Policy INF17 of the Borough-Wide Local Plan (adopted by the Borough Council on 23rd February 2001) states:- WHERE DEVELOPMENT IS PROPOSED ON LAND KNOWN TO BE UNSTABLE OR POTENTIALLY UNSTABLE AN APPLICANT WILL BE REQUIRED TO DEMONSTRATE THAT: (A) THE LAND IS PHYSICALLY CAPABLE OF BEING DEVELOPED; (B) THE INSTABILITY WOULD NOT HAVE ANY ADVERSE EFFECTS ON THE DEVELOPMENT; (C) THE DEVELOPMENT WOULD NOT HAVE ANY ADVERSE EFFECTS ON THE STABILITY OF ADJOINING LAND; (D) THERE WOULD BE NO SIGNIFICANT ADVERSE EFFECT ON LOCAL AMENITIES OR CONSERVATION INTERESTS; AND, (E) WHERE APPLICABLE, SATISFACTORY REMEDIAL OR PRECAUTIONARY MEASURES WOULD BE TAKEN AGAINST THE MIGRATION AND/OR PERCOLATION OF LAND-FILL AND NATURALLY OCCURING METHANE GAS. continued on next page:- |
| 2. | Irrespective of the supporting information regarding the foundation design and construction of the proposed dwelling, the Borough Council considers that there is a serious risk that the property could be affected by natural erosion during its lifetime, i.e. it is likely that the adjacent cliff will continue to be weather eroded until a natural angle of repose is achieved. Consequently, the proposal fails to satisfy the requirements of criteria (A), (B) and (C) of the above policy and is, therefore, contrary to the provisions of the Borough-Wide Local Plan. |
