1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the revised plans received by the Local Planning Authority on the 23rd April 2019 reference 6846-P01 rev F, 6846-P02 Rev C and Schedule of Works received on the 20th December 2018. The reason for the condition is :- For the avoidance of doubt.
3.Notwithstanding the annotation on the approved drawings reference 6846-P01 rev F and 6846-P02 Rev C prior to the installation of the panel to the eastern elevation following the removal of the ATM machine details of the type of glazing and making good shall be submitted to and approved by the Local Planning Authority. The glazing shall be carried out in accordance with the approved details. The reason for the condition is :- These details have not been submitted and the instillation of a glazed panel in this location should be controlled as it is in the most prominent elevation of the building.
4.Notwithstanding the annotations on the approved drawings reference 6846-P01 rev F, 6846-P02 Rev C and Schedule of Works received on the 20th December 2018 no masonry cleaning shall be undertaken prior to the submission and approval of details specifying the method. The masonry cleaning shall be carried out in accordance with the details approved. The reason for the condition is :- These details are not submitted and are required to ensure that the method applied is the correct one for this buildings particular fabric.
5.No alterations nor works, other than those expressly approved within condition 3 and 4 of this permission shall be carried out to the eastern elevation of the building. The reason for the condition is :- In the interest of clarity and the
6.No windows shall be installed or altered prior to the submission and approval of materials, specifications and details relating to repair of historic fabric are submitted to and approved by the Local Planning Authority. All alterations and replacements shall be carried out in accordance with the submitted details. The reason for the condition is :- These details have not been submitted and the materials and appearance are important to the buildings architectural importance.
7.Prior to the occupation of the unit identified on approved plan reference 6846-P01 as flat 10 details of screening to the southern and northern end of the balcony shall be submitted to and approved by the Local Planning Authority. The screening shall be erected in accordance with the approved details prior to occupation of the unit and shall remain in perpetuity. The reason for the condition is :- In the interest of the amenities of adjoining building users and occupiers.
8.Construction and refurbishment work shall not take place outside the following hours:- 07:30 to 18:30 Monday to Friday 08:30 to 13:30 Saturday and no work shall take place on Sundays or Bank Holidays. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
9.No part of the proposed structure (to include facia board/rainwater guttering), shall overhang or encroach upon highway land and no gate/door/ground floor window shall open outwards over the highway. The reason for the condition is :- In the interest of highway safety.
10.Prior to the first occupation of the development hereby permitted the proposed secure cycle parking shall be laid oud, demarcated, levelled surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the provision of adequate cycle parking that meets the needs of occupiers of the proposed development and in the interests of encouraging the use of sustainable modes of transport.
11.This proposal involves excavations adjacent to the public highway. It is an OFFENCE to carry out any works that may affect the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council.
12.Please be aware it is the applicants responsibility to clarify the boundary wit the public highway. Private structures such as fences or walls will not be permitted on highway land. The highway boundary may not match the applicants title plan. Please contact the highway research tea, at highway.boundaries@norfolk.gov.uk .
13.NOTES - Please read the following notes carefully:- The eastern commercial unit is annotated as 'office/shop'; this flexible use is approved however the developer and future users shall be aware that the first use shall become the approved use and there shall be no change without planning permission being applied for unless adequate provision exists with The Town and Country Planning (Use Classes) Order 1987 (as amended).
14.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017. In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £110 per each additional dwelling towards the monitoring and mitigation provided through that Strategy.
15.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria set out in Policies CS2 and CS10 of the Great Yarmouth Core Strategy.
