1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following approved Drawings: Site Location Plan ref: 12-174-001-P001-C, Hotel Plan ref: 12-174-001-P002 Rev C, Hotel Elevations ref: 12-174-001-P003 Rev B, Restaurant Elevations ref: 12-174-001-P004 Rev A, Plans and Elevations Ref: 12-174-001-P006 Rev E and any other drawings referred to in this planning permission. The reason for the condition is :-For the avoidance of doubt and in accordance with the submitted and approved plans.
3.The use of the A3/A5 drive thru restaurants and A3/A4 pub restaurant use here approved shall only be for purposes falling within Class A3/A5 and A3/A4 respectively as defined in the Town and Country Planning (Use Classes) Order 1987 (any order , and for no other purpose whatsoever, without express planning consent from the Local Planning Authority first being obtained The reason for the condition is :-For the local planning authority to control the use of the land and buildings in this out of town location.
4.Development shall not commence until scheme detailing provision for staff parking has been submitted and agreed by the local planning authority. The scheme shall be implemented and retained thereafter in the approved form The reason for the condition is :- To ensure adequate off-street parking is made for empoyees and in the interest of highway safety.
5.Prior to the commencement of the use hereby permitted the proposed access / on-site car and cycle parking / servicing / loading, unloading / turning / waiting area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking / manoeuvring area, in the interests of highway safety.
6.Development shall not commence until a scheme detailing provision for on site parking for construction workers for the duration of the construction period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented throughout the construction period. The reason for the condition is :- To ensure adequate off-street parking during construction in the interests of highway safety
7.Prior to the commencement of any works a Construction Traffic Management Plan and Access Route shall be submitted to and approved in writing with the Local Planning Authority in consultation with Norfolk County Council Highway Authority together with proposals to control and manage construction traffic using the 'Construction Traffic Access Route' and to ensure no other local roads are used by construction traffic. The reason for the condition is :-In the interests of maintaining highway efficiency and safety.
8.For the duration of the construction period all traffic associated with the construction of the development will comply with the Construction Traffic Management Plan and use only the 'Construction Traffic Access Route' and no other local roads unless approved in writing with the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is :-In the interests of maintaining highway efficiency and safety.
9.No works shall commence on site until the details of wheel cleaning facilities for construction vehicles have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is :-To prevent extraneous material being deposited on the highway.
10.For the duration of the construction period all traffic associated with the construction of the development permitted will use the approved wheel cleaning facilities provided referred to in Condition 9. The reason for the condition is :- To prevent extraneous material being deposited on the highway.
11.Notwithstanding the details indicated on the submitted drawings, prior to the first occupation of the development hereby permitted a detailed scheme for the off-site highway improvement works as shown indicatively on drawing numbered 25972-1013-009 Rev B will be submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority and the off-site highway improvement works shall be completed in accordance with the approved scheme to the written satisfaction of the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is :- To ensure that the highway improvement works are designed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor.
12.Other than demolition, there shall be no development above ground until details of flood resistance measures to keep flood waters out of the hotel building and a flood risk strategy for customers and staff shall be submitted to and approved by the LPA The reason for the condition is :-To ensure the safety of the occupiers of the development in the event of flooding
13.The hotels windows shall be constructed so as to have a sill height less than one metre (1m) above natural ground level. The reason for the condition is :-To ensure the safety of the occupiers of the development in the event of flooding.
14.Prior to the occupation of the hotel a Flood Response Plan (FRP) including the rate of onset of flooding, the availability of flood warnings, duration of flooding, depth of flooding and the length of the evacuation route shall be submitted to and approved by the LPA. The reason for the condition is :-To ensure the safety of the occupiers of the development in the event of flooding.
15.The hotel operator shall ensure that staff is fully appraised of the contents of the 'Flood Response Plan' (FRP) submitted with the applicationand are regularly updated. The implementation of the requirements of the FRP shall be carried out by the staff on site in the event of the need for the evacuation of the premises due to any form of Flood Alert/Warning and staff will fully inform visitors/customers of any action required. The reason for the condition is :- : To ensure the safety of the occupiers of the development in the event of flooding.
16.Other than demolition, there shall be no development above ground until a scheme has been submitted for the provision of fire hydrants on the development in a location agreed with the Local Planning Authority in consultation with the Norfolk Fire and Rescue Service and shall be a minimum of 150mm. The reason for the condition is :-The hydrants are needed to ensure that adequate water provision is made on site to tackle property fire
17.All hard and soft landscape works shall be carried out in accordance with the approved details. The works shall be carried out prior to the occupation or in accordance with a programme to be agreed in writing with the Local Planning Authority. Any trees or plants that within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of similar size and species as those originally planted, unless the Local Planning Authority gives written approval to any variation. The reason for the condition is :-In accordance with the submitted details and visual amemity of the area.
18.Prior to the first occupation of the development hereby approved, details of the method of lighting and extent of illumination to the access roads, footpaths, parking, and circulation areas shall be submitted to and approved in writing by the Local Planning Authority. The lighting scheme shall be implemented as approved prior to the occupation of the development or any phase of the development to which it relates and thereafter maintained and retained as agreed. The reason for the condition is :- Because such details have not been submitted and in the interests of minimising light pollution and to safeguard the amenities of the locality in accordance with the NPPF.
19.Other than demolition there shall be no development above ground until full details of the foul and surface water drainage arrangements for the site have been submitted to and approved in writing by the Local Planning Authority. The drainage details shall be constructed as approved before any part of the development hereby permitted is brought into use. The reason for the condition is :- To ensure that there is a satisfactory means of drainage in accordance with the NPPF
20.Other than demolition, there shall be no development above ground until a detailed scheme for the provision and implementation of pollution control measures has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented as approved before any part of the development hereby permitted is brought into use The reason for the condition is :-In order to prevent an increased risk of pollution to the water environment in accordance with the NPPF.
21.Prior to the opening of the individual unit details of any external means of ventilation/extraction shall be submitted and agreed to by the local planning authority. The reason for the condition is :-Because such details have not agreed.
22.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
23.Informative Notes - Please read the following notes carefully:- THIS PERMISSION IS SUBJECT TO AND SHOULD BE READ IN CONJUNCTION WITH AN AGREEMENT DATED ADD 19 December 2017 MADE PURSUANT TO SECTION 106 OF THE TOWN AND COUNTRY PLANNING ACT 1990. Inf.1: It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. This development involves work to the public highway that can only be undertaken within the scope of a Legal Agreement between the Applicant and the County Council. Please note that it is the Applicant¿s responsibility to ensure that, in addition to planning permission, any necessary Agreements under the Highways Act 1980 are also obtained. Advice on this matter can be obtained from the County Council¿s Highways Development Management Group based at County Hall in Norwich. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
