1.The development must be begun not later than two years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.No development shall commence until a detailed scheme for the construction, management and maintenance of the proposed turning areas, access and shared drives coloured blue on the plan received by the Local Planning Authority on the 20th February 2017 reference 169-P-S106 "Plan 4" have been submitted to and agreed by the Local Planning Authority in consultation with the Highways Authority. The reason for the condition is:- To ensure satisfactory development of the site and to ensure estate roads are managed and maintained thereafter to a suitable and safe standard.
3.No development shall commence until a detailed scheme for the construction, management and maintenance of the proposed pedestrian route coloured red on the plan received by the Local Planning Authority on the 20th February 2017 reference 169-P-S106 "Plan 3" have been submitted to and agreed by the Local Planning Authority in consultation with the Highway Authority. The pedestrian route shall be constructed in accordance with the detailed scheme as approved by the Local Planning Authority prior to the occupation of the 4th Dwelling hereby approved. The pedestrian route shall thereafter be maintained in accordance with the approved management and maintenance details. The reason for the condition is:- To ensure satisfactory development of the site and to ensure that the pedestrian routes are managed and maintained thereafter to a suitable and safe standard and not subject to adoption by the Highways Authority.
4.Notwithstanding the submitted details, unless otherwise agreed in writing by the Local Planning Authority the proposed private drive shall be maintained at a minimum width of 5.3 metres for its complete length and shall be constructed perpendicular to the highway carriageway for a minimum length of 30 metres as measured from the near edge of the highway carriageway. The reason for the condition is :- In the interest of highway safety and traffic movement.
5.Prior to the first occupation of the development hereby permitted a visibility splay measuring 2.4 X 43 metres shall be provided to each side of the access where it meets the highway and such splays shall thereafter be maintained free from any obstruction exceeding 0.6 metres above the level of the adjacent highway carriageway. The reason for the condition is:- In the interests of highway safety.
6.Prior to the first occupation of the development hereby permitted the proposed access, on-site car parking, and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and detailed scheme as approved by the Local Planning Authority and retained thereafter available for that specific use. The reason for the condition is:- To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety.
7.Notwithstanding the details indicated on the submitted drawings no works shall commence on site until a detailed scheme for the off-site highway improvement works (access, footway and bus stop works) as indicated on drawing number 169-P-003 Rev 1 have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is:- To ensure that the highway improvement works are designed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor.
8.Prior to the first occupation of the development hereby permitted the off-site highway improvement works referred to at condition 7 of this planning permission shall be completed to the written satisfaction of the Local Planning Authority in consultation with the Highway Authority. The reason for the condition is:- To ensure that the highway improvement works are completed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor.
9.Prior to the commencement of the development hereby approved the finished floor levels as proposed shall be submitted to and approved by the Local Planning Authority. The development shall be carried out in accordance with these details. The reason for the condition is:- To ensure an adequate form of development.
10.The development hereby approved is for nine dwellings only. The reason for the condition is:- For the avoidance of doubt.
11.The development shall be carried out in accordance with the revised plan received by the Local Planning Authority on 4th May 2016, additional information received by the Local Planning Authority on the 16th March 2017 and the forms, plans and associated information received on the 10th December 2015 excluding information submitted relating to numbers which has been superceeded. The reason for the condition is :- For the avoidance of doubt.
12.Prior to the commencement of the development hereby approved details of the size and siting of the garages shall be submitted to and approved by the Local Planning Authority. The garages shall be constructed prior to the occupation of the dwelling to which they relate. The reason for the condition is:- The details were not provided as part of the application and are required to ensure an adequate form of development.
13.Prior to the commencement of the development hereby approved details of all boundary treatments are to be submitted to and approved by the Local Planning Authority. The boundary treatments that relate to properties are to be in place prior to the occupation of the property to which they relate. Boundary treatments that are not related to a property are to be erected prior to the first occupation of any of the dwellings hereby approved. The reason for the condition is:- To ensure that adequate boundary treatments are provided.
14.Prior to the commencement of the development hereby approved details of wheel washing facilities shall be submitted to and approved by the Local Planning Authority and shall be provided on site for the duration of the construction in the approved location. These facilities shall be utilised by all construction traffic prior to exiting the site. The reason for the condition is:- To ensure that the construction debris does not leave the site.
15.Prior to the commencement of the development hereby approved details of the soft landscaping shall be submitted to and approved by the Local Planning Authority. The details shall include all proposed planting and details of the enlargement of the pond as annotated on the approved plan received by the Local Planning Authority on the 4th May 2016. The works shall be carried out in accordance with the approved details prior to the occupation of the 4th dwelling hereby approved. The reason for the condition is:- To ensure that the pond is enlarged and the planting is carried out.
16.It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. This development involves work to the public highway that can only be undertaken within the scope of a Legal Agreement between the applicant and the County Council. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary Agreements under the Highways Act 1980 are also obtained. Advice on this matter can be obtained from the County Council's Highways Development Management Group based at County Hall in Norwich. Please contact Developer Services on 03444 8000 8020. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer. If required, street furniture will need to be repositioned at the applicant's expense.
17.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
18.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria set out in saved Policy CS2 of the Great Yarmouth Core Strategy.
